No person, firm or corporation, without first having procured a permit
therefor, as hereinafter provided, shall, outside the corporate limits of
the villages in the Town of Union, exhibit or conduct out of doors, in tents
or in any other temporary structure, any carnival, field days, road show,
circus, rodeo, menagerie or similar exhibition or performance, or any show,
exhibition, performance, concession or refreshment stand in conjunction therewith,
for which an admission of any kind or nature is charged.
A.
An application for a permit for such carnival, field
days, road show, circus, rodeo, menagerie or similar exhibition or performance
must be in writing and filed with the Town Clerk for consideration by the
Town Board and must state the name and address of the applicant and the name
and address of the person or corporation that is hosting or sponsoring the
performance, exhibition or concession applied for.
B.
A notice indicating the time and place of a public hearing
on such application shall be published at least five and not more than 20
days before final action thereon by the Town Board.
If, after such hearing, the Town Board determines that it is in the
public interest that a permit be granted to the applicant, the same shall
be granted, upon the permittee filing with the Town Clerk a bond by a duly
licensed bonding company for the faithful compliance by the permittee with
the conditions contained in the permit and upon payment by the applicant of
the fees as set from time to time by resolution of the Town Board.
A.
The Town Board of the Town of Union shall issue all permits,
which shall be signed by the Supervisor and countersigned by the Town Clerk,
who shall keep a record thereof, including the number and date of the permit,
the time and purpose for which it is granted and the amount of fee to be paid
therefor, and upon the payment to the Town Clerk of the specified fee the
Town Clerk shall endorse the receipt of the permit fee, showing that such
fee is paid. A permit shall not take effect until the receipt of the Town
Clerk is endorsed, showing that the fee has been paid. A permit shall only
be issued to such person, firm or corporation as the Town Board deems to be
a fit and proper person, firm or corporation to conduct the performance for
which such permit is required.
B.
The Supervisor of the Town may suspend any permit previously
granted until the next meeting of the Town Board and thereupon such a permit
may be continued, or it may be revoked by the Town Board for cause shown,
after notice to the permittee. Every such permit shall specify the object
and length of time for which it is granted and when it shall expire.
C.
Whenever any permit shall have been revoked by the Town
Board, a notice of such revocation shall be served by the Town Clerk upon
the permittee, either personally or by mail, whereupon such permit shall be
of no force or effect.
Any person, firm, association or corporation who or which shall violate
any of the provisions of this chapter shall forfeit and pay a penalty of not
to exceed $250 or be imprisoned for a period not to exceed 15 days, or both,
for each offense.
