Every owner of real property in the Borough of Media shall keep and maintain the curbs and sidewalks in good repair within any public right-of-way upon which the property abuts or wherein the property is located.

In any location where there is presently no curbing or sidewalk constructed in or upon the right-of-way of any street in the Borough of Media, the installations of curbing and sidewalk shall be undertaken upon direction of the Borough of Media upon reasonable notice.
Sidewalks and curbs shall be constructed and repaired with test concrete of no less than 3,000 pounds per square inch, which shall be laid at a thickness of no less than four inches upon well-drained and prepared subsoil. Where sidewalks are to be part of a driveway surface, the concrete shall be no less than six inches in thickness. All curbing shall be no less than 18 inches in height and shall be no less than six inches in thickness at the top of the curbing and eight inches thick at the bottom. Any alternative materials of equal or better durability shall be permitted upon submission of the specifications and standards for the use of alternative materials in curbs and sidewalks and by approval of the Building Inspector of the Borough of Media. Any sidewalk presently constructed of paving brick shall continue to be maintained as a sidewalk of paving brick. No sidewalk so constructed shall be removed or replaced except upon application to the Building Inspector of the Borough of Media and upon showing that repair and maintenance is impossible or impractical.
Standards for radius specifications, concrete finishing, concrete reinforcements, expansion joints and other such specifications shall be as prepared by the Engineer of the Borough of Media and as approved by the Council of the Borough of Media by resolution.
The Building Inspector of the Borough of Media shall annually list and record properties where curbing and sidewalk are in the state of disrepair. Notices shall be sent forthwith to the property owners notifying such property owners that the noted repairs shall be completed within 120 days of the date of such notice.
Notice shall be given first by a writing addressed to the property owner at the best address available by certified mail; alternative notice shall be delivered to the resident, occupant or tenant of the property, if any.
All work shall be completed within said 120 days of the notice; except, however, a reasonable extension of time may be given for the completion of the work if the property owner, prior to the one-hundred-twenty-day period, shall supply to the Building Inspector a bona fide contract with a construction contractor for the undertaking of the repair work, which contract calls for the completion of the work within 60 days of its execution.
The Council of the Borough of Media shall annually advertise for bids for construction of curbs and sidewalks on a unit basis, which work shall be performed within the calendar year of the date of the advertising and award of the contract. Such contractor shall then exclusively be engaged for the maintenance and repair of curbs and sidewalks which have not been repaired by the property owners pursuant to the notice as given aforesaid. Any costs incurred by the Borough of Media for the maintenance and repair of curbs and sidewalks as performed by such contractor shall be paid to the Borough by the property owner. Failure to pay within 30 days of the submission of the bill for repairs shall subject the property to the imposition of a municipal lien for the cost expended plus 10% for the Borough supervision and cost of securing the lien on the property.
If at any time it is determined by the Borough of Media that a curb or sidewalk is in such a state of disrepair as to create an unusual risk of harm or create extraordinary danger to the public, the Building Inspector of the Borough may cause immediate and temporary repairs to be made until such time as repairs, pursuant to the standards of this article, can be made by the owner. The cost of emergency repairs shall be borne by the property owner and shall be enforced by municipal lien if necessary.

A. 
All curbs and sidewalks constructed or replaced on or after July 1, 1994, in the Borough of Media in all Zoning Districts shall be designed with cuts at all pedestrian crosswalks to provide adequate and reasonable access for the safe and convenient movement of physically handicapped persons. Such cuts shall comply with the latest version of the ANSI 117.1 standards.

B. 
It shall be the duty of the person responsible for having said curb and/or sidewalk constructed or replaced to obtain a permit for the same, with plans to be approved by the Building Inspector of the Borough.

Any person, firm or corporation who or which shall violate any of the provisions of this article shall, upon conviction, be punishable by a fine not exceeding $600, plus costs of prosecution and, in default of payment of such fine and costs, by imprisonment for a period not exceeding 90 days.
