Joint Sewer Authority — See Ch. 124.

This Borough grants to the Authority, its successors and assigns, all easements, rights-of-way and other rights and privileges necessary and desirable in, along, over and under streets, roads, lanes, courts, culs-de-sac, public ways, public squares, alleys and other properties of this Borough, together with free ingress, egress and regress therein and thereto, along with other persons having interests, rights or privileges therein, for use in connection with constructing, replacing, repairing, altering, maintaining and operating the sewer system, as the same shall exist, from time to time.
The rights and privileges granted to the Authority under § 80-1 shall be exercised by the Authority under and subject to such reasonable rules, regulations and conditions as shall be adopted and specified, from time to time, by the Borough; and this Borough reserves the right to adopt and specify, from time to time, such reasonable rules, regulations and conditions in connection with the exercise by the Authority of such rights and privileges.

It is the desire of the Council of the Borough of South Waverly of the Borough of South Waverly in the County of Bradford and Commonwealth of Pennsylvania and said Borough Council hereby signifies its intention to amend the articles of an Authority under the Municipality Authorities Act of May 2, 1945, P.L. 382, as amended. See now 53 Pa.C.S.A. § 5601 et seq.
The projects undertaken by said Authority are construction of sewers, sewer systems and sewage disposal plants, as well as any related uses thereof, and the collection of charges therefor. No other authority has been organized under the Act of 1945, P.L. 382, or under the Act approved June 28, 1935, P.L. 463, see now 53 Pa.C.S.A. § 5601 et seq., by the Borough of South Waverly or is in existence in or for said Borough of South Waverly, the incorporating municipality.
The proper officers of the Borough are hereby authorized and directed to amend the articles of said Authority and to execute an amended articles of incorporation and file the same with the Secretary of the Commonwealth of Pennsylvania as provided by law.
In pursuance of said desire and intention and in conformity with the provisions of said Municipality Authorities Act and its amendments, the proposed amended articles of incorporation are hereby set forth in full as follows.[1]
