There shall be a Planning Board as established in Chapter 109 of this Code.
All appeals and hearings by the Planning Board shall be conducted in accordance with requirements of the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
The Planning Board may require that conditional uses be periodically renewed. Such renewal shall be granted following public notice and hearing, and may be withheld only upon a determination by the Construction Official to the effect that such conditions with the issuance of the original conditional use have not been or are being no longer complied with. In such cases, a period of 60 days shall be granted the applicant for full compliance prior to the revocation of the conditional use. Any use for which a conditional use may be granted shall be deemed to be a conforming use in the district in which such use is located, provided that:
A. 
The provision of this chapter under which such conditional use was issued is still in effect;
B. 
Such conditional use was issued in conformity with the provisions of this chapter;
C. 
Such conditional use shall be deemed to affect only the lot or portion thereof for which such permit shall have been granted.
A. 
Whenever the Planning Board grants a variance of the minimum yard dimensions as set forth in Article XIX, the applicant for such variance shall furnish to the Construction Official two copies of a survey of the premises for which the variance has been granted. The survey shall show thereon the courses and dimensions of the perimeter of the premises, the location of the proposed construction to which the variance relates, the distance from the construction to all lot lines of the premises, and the location of all existing buildings on the premises.
B. 
The survey shall be furnished to the Construction Official upon completion of the installation of the foundation, if any, of the proposed construction and prior to the commencement of any further work thereon. In the event no foundation is to be constructed, then the survey shall be furnished to the Construction Official prior to the commencement of any of the work to which the variance relates.
C. 
The survey shall be prepared to scale by a New Jersey licensed land surveyor, who shall certify thereon that the same is a true and accurate survey.
