Editor’s Note: This chapter was extensively
amended 12-27-2005 by L.L. No. 7-2005 in accordance with the goals
and objectives outlined in the 2005 update to the Town Comprehensive
Plan. Specific amendments are indicated in the text throughout this
chapter. This local law provided that it shall apply to all new land
development applications for site plan, special permit or conditional
use permit, or subdivision approval and to all pending land development
applications for site plan, special permit or conditional use permit,
or subdivision approval except those pending applications for which
site plan or preliminary subdivision plat approval has been granted
by the appropriate board prior to 12-27-2005. Any such application
for which site plan or preliminary subdivision plat approval has been
granted must apply for and receive either a building permit or final
subdivision plat approval prior to 12-27-2006. If a building permit
or final subdivision plat approval is not received prior to 12-27-2006,
then the site plan or preliminary subdivision plat approval shall
be deemed null and void and the property shall be subject to the requirements
of L.L. No. 7-2005. No extensions of time shall be granted. No physical
improvements or modifications to the land in relation to any pending
site plan or preliminary subdivision plat application, or in relation
to any approved site plan or preliminary subdivision plat, shall be
made until a building permit or final subdivision plat approval is
granted and all documents and performance bonds are appropriately
filed with the Town and/or County Clerk.
