A.Â
It
shall be unlawful for the owner, custodian or keeper of any dog to
permit such dog to run at large at any time on any property, either
public or private, within the Borough of Baldwin, excluding, however,
the private property of the owner, custodian or keeper of such dog.
B.Â
It
shall be unlawful for the owner, custodian or keeper of any pet or
other domestic animal to allow said animal to run at large at any
time in any public park located within the Borough of Baldwin, or
for such owner, custodian or keeper of any pet or domestic animal
to enter any public park located within the Borough of Baldwin with
a pet or other domestic animal. The use of a leash or other form of
restraint shall not excuse any owner from the prohibition contained
herein.

Any
household pet which scratches, digs or defecates upon any lawn, tree
shrub, plant, building or any other public or private property, other
than the property of the owner or person in charge or control of such
animal, is hereby declared to be a nuisance.

D.Â
Any
household pet which, by frequent and habitual barking, howling, screeching,
yelping or baying or in any way or manner injures or disturbs the
quiet of any person or the community or which disturbs or endangers
the comfort, repose or health of persons, is hereby declared to be
committing a nuisance. It shall be unlawful to harbor or permit it
to commit such a nuisance.

E.Â
No
person being the owner or in charge or control of any household pet
shall allow or permit such animal to commit a nuisance on any school
grounds or other public property or upon any private property other
than that of the owner or person in charge or control of such household
pet without the permission of the owner of said property. Where the
owner or person in charge or control of such animal immediately removes
all feces deposited by such animal and disposes of same in a sanitary
manner, such nuisance shall be considered abated.

No
more than four household pets over the age of six months may be kept
on any premises in the Borough.

G.Â
The
keeper of every such household pet shall cause the litter and droppings
therefrom to be collected daily in a container or receptacle of such
type that, when closed, it shall be ratproof and fly-tight, and after
every such collection shall cause such container or receptacle to
be kept closed. At least twice a week, every such keeper shall cause
all litter and droppings so collected to be disposed of in such a
manner as not to permit the presence of fly larvae.

Between the first day of January 1969 and the 28th day of February
1969 and between January 1 and February 28 of each and every year
thereafter, the owner, custodian or keeper of any dog more than six
months old shall make application to the Borough of Baldwin for a
license for such dog. The application shall state the breed, sex,
age and general colors and markings of the dog for which a license
is desired and the name and address of the owner thereof. Each application
shall be accompanied by a fee of $5.
An application for a dog license shall be accompanied by a certificate
of a duly authorized veterinarian indicating that the particular dog
was inoculated against rabies within the three years next preceding
the date of application.
Upon receipt of a duly completed application and a veterinarian's
certificate, the Borough of Baldwin shall issue such applicant a dog
license and an official tag. It shall thereafter be the duty of the
applicant to affix the tag upon a collar or harness attached to the
dog, and no dog at any time shall be permitted within the limits of
the Borough of Baldwin unless it shall wear the tag attached to its
collar or harness.
The Borough Council of the Borough of Baldwin may appoint a
person, firm or corporation who shall be designated as the enforcement
officer for the terms and provisions of this chapter. The Borough
Council shall, by motion, provide for the compensation of such enforcement
officer. Such enforcement officer shall establish rules and regulations,
subject to prior approval by the Borough Council, for the care, supervision
and disposition of any dogs which may come within the jurisdiction
and control of such enforcement officer. Each and every police officer
of the Borough of Baldwin shall have the power and the duty to enforce
the provisions of this chapter.
Any dog, either licensed or unlicensed, which may be found running
at large upon any public or private property in the Borough of Baldwin
(except the property of the owner, custodian or keeper of such dog),
shall be taken into custody by any police officer of the Borough of
Baldwin or by the enforcement officer. The rules and regulations promulgated
by the enforcement officer and approved by the Borough Council of
the Borough of Baldwin shall be applicable to the disposition of any
such dog taken into custody.

Any person, firm or corporation which may operate a dog kennel
within the limits of the Borough of Baldwin, as permitted under the
zoning ordinances of the Borough of Baldwin, shall secure a kennel
license. The enforcement officer provided for in this chapter shall
periodically inspect such kennels to determine the safety, sanitary
and health conditions of such kennel. No dog shall be permitted to
remain at any kennel unless a certificate of a duly authorized veterinarian
is produced indicating that such dog has been inoculated against rabies
within the past three years. The enforcement officer may, upon approval
of the Borough Council of the Borough of Baldwin, establish rules
and regulations for the operation of a kennel within the Borough of
Baldwin in such places as are permitted by the Zoning Ordinance of
the Borough of Baldwin. The fee for the issuance of a kennel license
shall be $10.
The Borough of Baldwin shall provide for the issuance of duplicate
dog license tags in the event that the original tag has been lost
or stolen. Prior to the issuance of such duplicate license, the owner
of the dog shall file with the Borough an affidavit indicating the
reason for the reissuance of a duplicate tag.

Any person, firm or corporation who or which shall violate any
provisions of this chapter, upon conviction thereof before the District
Magistrate, shall be sentenced to pay a fine not to exceed the sum
of $1,000 plus costs of prosecution and, for the failure to pay the
same, be imprisoned for a term not to exceed 30 days, or both.

As used in this chapter, the following words and terms shall have
the meanings hereby respectively ascribed thereto, except where the
context clearly indicates a different meaning:
Any animal as hereinafter defined as a household pet, a large
animal or a small animal.
Any dog, cat or other domestic animal normally and ordinarily
kept in or permitted to be at large in the dwelling of its owner.
Any domestic animal of the bovine, equine, sheep or hog family.
Any person, firm, partnership, association or corporation.
Any domestic animal such as a rabbit, hare, guinea pig, rat,
mouse or chinchilla and any domestic fowl such as a chick, turkey,
goose, duck or pigeon.
Any animal, bird, fowl or reptile not normally or ordinarily
domesticated, not normally or ordinarily raised in this area and climate
as livestock or for work or breeding purposes, or not normally or
ordinarily kept as a household pet.

In this chapter, the singular shall include the plural, the plural
shall include the singular, and the masculine shall include the feminine.
