Rental property registration — See Ch. 133, Art. I.

A. 
Every person, firm or corporation owning or managing any residential property within the Borough of Baldwin which is rented, in whole or in part, to one or more persons shall certify to the Borough, for each rental property address, the name, mailing address and telephone number of the owner and all of the tenants occupying the rental property.
B. 
Certifications shall be made on or before January 31, annually, on rental property information forms that may be obtained, upon request, at the Borough Municipal Building.
C. 
The annual certification shall be accompanied by a filing fee, which shall be initially established at a fee of $10 to cover the administrative costs of the Borough relating to the identification of renters for public safety, emergency, garbage, sewer and tax purposes. If a change in tenant's occupancy occurs midyear, the owner shall provide to the Borough the new tenant information within 15 days of the change occurring but shall not be subject to a new filing fee except at the annual certification.
D. 
Borough Council may amend the amount of the fee in a fee resolution from time to time.
E. 
Any person, firm or corporation owning any residential rental property within the Borough of Baldwin who fails to certify the names and mailing addresses of the tenants to the Borough of Baldwin, or fails to cause their agent or management corporation to file such a certification, shall also be liable for all unpaid, nonlienable Borough services provided to the property until the person owning the property complies with the requirements of Subsections A through C of this section hereinabove listed.

Any person, partners or principal officers of any firm or such officer responsible for the performance of the duties required in this chapter or the chief executive officer of such corporation violating any of the provisions of this chapter shall, upon conviction thereof before any District Magistrate, be fined not less than $50 not more than $600 for each offense together with any costs of the proceedings against the person.
In addition to the normal advertising requirements of law, a copy of this chapter will be posted in the lobby of the Borough Building for a period of 30 days, and the Secretary of the Borough shall give written notice of the contents of this chapter to all rental agencies and real estate agencies in the Borough of Baldwin, South Hills Multi-List, Inc., and to any and all other real estate agencies situate outside the Borough of Baldwin but known to be leasing or renting properties on behalf of owners, which property is located in the Borough of Baldwin.
