From and after the effective date hereof, the use and/or possession
of alcoholic beverages of any kind, including liquors, wines, beers,
coolers and any other alcoholic beverages intended for consumption
and commonly known as "alcoholic beverages," is prohibited in any
public park or recreational area of the Borough at all times.
Excluded from the provisions of this article shall be all park
areas or recreational areas or buildings of the Borough leased or
used by persons having permits for the same, which permits shall have
been approved by the Council of the Borough and issued by the Borough
officers; and provided further, however, that any persons seeking
permits for the use of such park areas or recreational areas or buildings
wherein alcoholic beverages may be served shall make known the same
to the Borough Council in their application for use of the areas or
buildings, and provided further that such alcoholic beverages shall
be served in a lawful manner and only during the hours for which the
permit is issued.
Any person, firm or corporation who or which shall violate or
fail, neglect or refuse to comply with any of the provisions of this
article shall, upon conviction thereof, be sentenced to pay a fine
of not more than $500 and the costs of prosecution or, upon failure
to pay such fine, to imprisonment for a period not exceeding five
days.
