There is hereby established the position of Construction Code Official of the Town of West New York, who will be charged with the duty and responsibility of enforcement of the New Jersey Uniform Construction Code. The duties of the Construction Code Official shall be enforcement and regulation of said code, and he shall:
A. 
Provide that applications are available and assist the public in preparing the applications whenever necessary.
B. 
Review all applications for completeness as to form and for verification of prior approvals. He may request additional documentation concerning prior approvals whenever it is deemed necessary.
C. 
Upon receipt of the completed application, determine the proper fee for the work required.
D. 
Collect all fees and penalties and ensure that funds are properly accounted for.
E. 
Ensure that the proper subcode official shall have an adequate time period to review appropriate applications, plans and specifications.
F. 
Ensure that all requests for variation are properly prepared.
G. 
Issue the construction permit upon receiving the approval of all appropriate subcode officials.
H. 
Record all notices of violation upon receiving notification of the appropriate subcode official and determine all penalties for noncompliance with the penalty notices.
I. 
Ensure that all required inspections are scheduled and performed within three business days of the time for which inspection has been requested.
J. 
Ensure that the reports of all inspections are completed and properly filed.
K. 
Record stop-work orders upon notification of the appropriate subcode official.
L. 
Ensure that all final inspections have been completed prior to the issuance of a certificate of occupancy and ensure that all inspections required for the purpose have been completed prior to the issuance of a temporary certificate of occupancy.
M. 
Issue the certificate of occupancy upon receiving the approval of all appropriate subcode officials and issue the temporary certificate of occupancy upon receiving the approval of all appropriate subcode officials.
N. 
Ensure, in the case of a change of use, or upon a request for a certificate of continued occupancy, that each subcode official gives an approval based on an inspection and the review of all submitted data before issuing a certificate of continued occupancy.
O. 
Prepare and obtain reports required in the regulations.
P. 
Attend meetings and hearings as required by the regulations.
Q. 
Carry out such other functions as are necessary and appropriate to the position of Construction Official and any and all other matters that may be delegated to him by the Mayor and Commissioners of the Town of West New York or the New Jersey Department of Community Affairs which relate to the New Jersey Uniform Construction Code.
Said Construction Official shall have the authority to overrule a decision of any subcode official, provided that the Construction Code Official is qualified and certified in that particular subcode.

The annual salary of the Construction Code Official shall be the sum as set forth in the relevant Salary Ordinance pertaining to the said position. Said annual salary within said range shall be fixed from time to time by the Mayor and Commissioners of the Town of West New York, which annual salary so fixed shall be paid in semimonthly payments.[1]
