A. 
The terms automobile, commercial motor vehicle, noncommercial truck, motorized bicycle, motorcycle, motor-drawn vehicle, motor vehicle, passenger automobile, pole trailer, omnibus, semitrailer, trailer, truck, truck-tractor and vehicle, as used in this chapter, shall be as defined in N.J.S.A. 39:1-1, as amended. The terms driver, owner, operator and person, as used in this chapter shall be as defined in N.J.S.A. 39:1-1, as amended.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
OPEN LOT
Any land or portion thereof which does not contain a building or structure, as those terms are defined in the Chapter 414, Zoning, and which is not zoned to permit storage of vehicles.
It shall be unlawful for any owner, operator or person, as heretofore defined, to use any automobile, commercial motor vehicle, noncommercial truck, motorized bicycle, motorcycle, motor-drawn vehicle, motor vehicle, passenger automobile, pole trailer, omnibus, semitrailer, trailer, truck, truck-tractor and vehicle, as heretofore defined, or any other vehicle not within those definitions, for repair of that or any other vehicle, storage of that vehicle or sale or distribution of goods from or within that vehicle while said vehicle is upon any open lot.
There shall be a presumption that any vehicle not removed from the open lot for at least eight consecutive hours within any period of 72 consecutive hours is being used for storage purposes.
This chapter shall not apply to any vehicles as heretofore defined, which:
A. 
Are owned or operated by the Town of West New York or any municipal agency of the Town of West New York.
B. 
School buses or other vehicles authorized by the West New York Board of Education or the Town of West New York as to any public or private school.
C. 
Any other owner, operator or person granted temporary permission, not to exceed 30 days, by the Mayor and Board of Commissioners to be exempt from this chapter.
D. 
Any vehicles stored on property for which storage of vehicles is permitted under the provisions of Chapter 414, Zoning.
Any law enforcement officer, code official or municipal inspector can issue a summons for violation of this chapter. Any person who shall violate any provision of or order promulgated under this chapter shall, upon conviction thereof, be liable to a penalty as provided in Chapter 1, General Provisions, Article I.
