Building construction — See Ch. 94.
All lands within the following described limits or boundaries shall be designated as a Fire Zone within which only buildings of noncombustible material and fire proof roofs shall be erected, constructed or added to: beginning at a point in the south line of Easton Street produced, 130 feet west from the west line of Fraley Street; thence south, parallel with the west line of Fraley Street, and 130 feet west therefrom, to the north line of Chestnut Street; thence east along the north line of Chestnut Street to the northwest corner of Fraley and Chestnut Streets; thence further east to the northeast corner of Fraley and Chestnut Streets; thence further east along the north line of Chestnut Street to the west line of South Edgar Street and Edgar Street to the north line of Greeves Street; thence west along the north line of Greeves Street to a point therein 150 feet east from the east line of Chase Street; thence north parallel with the east line of Chase Street and 150 feet distant therefrom to the south line of Easton Street produced; thence west along said line to the place of beginning.
Every building, or part thereof, hereafter erected within said limits, and every addition to every building now standing therein shall be constructed with walls wholly of brick, brick veneer, stone, concrete, tile, terra cotta or stucco and shall have the roof and also the sides of all roof structures, including the dormer windows, covered with fire resistant material.
Buildings with wooden frames, clad with sheet iron shall be classed as frame buildings.
No frame building or structure shall be hereafter built or constructed within said limits, except the following: temporary one-story frame buildings for use of builders, wooden fences not over eight feet high, porches or balconies not exceeding 10 feet in width or extending more than three feet above the second story floor beams, or bay windows, when covered with fire resistant material.
No frame structure shall be removed from without to within said fire limits; and no frame structure shall be removed from one place to another within said limits.
Any existing frame building within said fire limits which may hereafter be damaged by fire, decay or otherwise to an amount equal to 2/3 of the present value, exclusive of foundation, shall not be repaired or rebuilt, but shall be removed. Any wooden, shingle or other non-fire-resistant roof within said limits hereafter damaged by fire, decay or otherwise shall not be repaired, but shall be replaced by a roof of fire resistant covering.
Except as hereafter provided, all chimneys in every building hereafter erected within said limits and all chimneys hereafter erected shall be constructed of brick, stone or reinforced concrete. No chimney shall have a flue less than 64 square inches inside. All chimneys shall project as least two feet above the roof. Chimneys shall not rest upon wooden foundations or be hung from wooden rafters, but shall be built upon concrete or masonry foundations.
All electric installation in said limits shall be in accordance with the National Electric Code, and no installation of electric equipment shall be made except in conformity thereto.
No smoke pipe shall be within six inches of any woodwork or any wooden lath partition or ceiling and no smoke pipe shall pass through any floor, partition or ceiling having a wooden frame work covering unless guarded by a galvanized ventilated thimble at least four inches larger in diameter than the smoke pipe. No smoke pipe shall pass through any roof or enter a chimney in the attic or garret.
All materials used in any construction within said fire limits shall be of good quality, and all parts of every building shall be designed to carry safely the load to be imposed thereon and shall in all other respects conform to good engineering and architectural practice.
Immediately after the passing of this chapter and on the organization of every new Council, the President shall appoint four members of the Council who shall be known as the "Building Committee."
Any person or persons, firm or corporation desiring to build, rebuild or remodel any building or structure of any size or character within said fire zone, or at any other place within the limits of the Borough of Kane, shall first file with the Borough Manager a plan, together with specifications showing location, size, character, material and intended use, and estimated-cost of the proposed structure, and the same shall be examined by said Building Committee, and if the same are in accordance with this chapter, then said Building Committee shall issue their permit therefor. The permit shall be issued by Borough Manager at the direction of said Building Committee or a majority thereof. The fee for issuing said permit shall be 1/10th of 1% of the proposed cost of said new building or alteration or repair; provided that in no case shall the fee be less than $10, and which said fee shall be paid into the borough treasury. The fee herein provided, to be paid may be increased or decreased from time to time by action of the Council without the amendment of this chapter.
No building, structure or addition thereto shall hereafter be built or constructed within said fire zone or at any other place within the limits of the Borough of Kane, unless, and until, a permit as hereinbefore provided shall have been obtained therefor from said Building Committee.
The Borough Manager of said Borough shall be known as the "Building Inspector." It shall be the duty of said Building Inspector to perform such duties as may be designated for him by said Building Committee and to make such investigation from time to time as may be necessary for the enforcement hereof.

Any and all persons, who shall violate the provisions of this chapter, on conviction thereof, shall be fined not exceeding $300, and costs, for each offense, and, in default of payment of the fine and costs, shall be subject to imprisonment in the McKean County Jail for a period not exceeding 30 days.
Any building or other structure erected or constructed in violation hereof shall be deemed and taken as a public nuisance and shall be subject to abatement.
