A. 
In general. Subject to the provisions of this section, Queen Anne's County is declared to be a Sanitary District for the purpose of the exercise of the powers vested by this Part 1 in the County Commissioners of Queen Anne's County (hereafter referred to as "the County").
B. 
Scope of authority. Except for facilities within the corporate limits of any municipality over which the County or a County agency may have exercised jurisdiction before June 1, 1972, the County may not exercise authority over:
(1) 
The operation or construction of sewerage, water, drainage, or solid waste facilities of an incorporated municipality; or
(2) 
The administration and enforcement of rules and regulations relating to building and plumbing codes of any incorporated municipality.
C. 
Petition by municipality. On a petition by the governing body of a municipality, the County may enter the incorporated municipality in cooperation with the municipality for:
(1) 
The operation, construction, and maintenance of water, sewerage, drainage, and solid waste facilities; and
(2) 
The administration and enforcement of regulations relating to building and plumbing codes within that municipality.
D. 
Acquisition within municipality. The County may, either jointly with an incorporated municipality or independently, acquire by purchase or condemnation any land, structure, building, or franchise of a privately owned water, sewerage, or solid waste system within any municipality.
E. 
Extension beyond corporate limits of municipality.
(1) 
An incorporated municipality may not extend the water, sewerage, drainage, or solid waste facilities of the municipality beyond the corporate limits of the municipality without the express approval and authority of the County.
(2) 
Notwithstanding Subsection E(1) of this section, approval is not required in the event of annexation by the municipality under Article 23A of the Annotated Code of Maryland.
F. 
County not subject to certain planning regulations or zoning ordinances. In exercising the powers granted by this Part 1, the County is not subject to the provisions of any planning regulations or zoning ordinances enacted under Article 66B of the Annotated Code of Maryland.
