[HISTORY: Adopted by the Board of Trustees of the Village of Atlantic Beach 3-13-1974 by L.L. No. 2-1974. Amendments noted where applicable.]
It is hereby declared to be the intent and policy of the Incorporated Village of Atlantic Beach, County of Nassau, State of New York, to preserve, protect and maintain the clean wholesome character of the Incorporated Village of Atlantic Beach, to preserve and maintain the health and welfare of the residents.
The following words and phrases shall have the meaning ascribed to them below, all other words and phrases shall have the meaning normally ascribed to them unless a contrary meaning is clearly apparent from the content:
LITTER
Any and all discarded material, including ashes, garbage, paper, empty containers, rubbish, refuse, handbills, pamphlets, tracts, and other like material or other debris of a nondescript nature.
PERSON
Any individual, partnership, corporation or unincorporated association.
PUBLIC PLACE
Any highway, road, street, avenue, alley, park, playground, public parking area, beach, bay end, public driveway, or any property under the ownership or control of the Incorporated Village of Atlantic Beach or any property open to and/or serving the general public.
No person shall litter, sweep, throw or cast, or direct, suffer or permit any servant, agent or employee, or any person under his control to litter, sweep, throw or cast any litter in or upon any street, public place, vacant lot, beach, bay end, or area within the Incorporated Village of Atlantic Beach.
The owner, lessee, tenant or occupant or person in charge of any building or premises shall keep and cause to be kept the sidewalk and all area abutting the building or premises free from obstruction, nuisance and any and all litter.
Any person found guilty of violating this chapter shall be punished by and subject to a fine of not more than $500 or imprisonment not to exceed 15 days, or both, for each violation.
