[HISTORY: Adopted by the Board of Trustees of the Village of Atlantic Beach 10-18-1976 by L.L. No. 2-1976. Amendments noted where applicable.]
It is hereby declared to be the intent and policy of the Incorporated Village of Atlantic Beach, County of Nassau, State of New York to preserve and maintain the residential and wholesome character of the Incorporated Village of Atlantic Beach, and to protect the health, safety and welfare of its residents and inhabitants.
The following words and phrases shall have the meaning ascribed to them below; all other words and phrases shall have meaning normally ascribed to them unless a contrary meaning is clearly apparent from the content:
FAMILY
Any number of persons related by blood, adoption or marriage, living and cooking together as a single housekeeping unit. A number of persons not exceeding two not related by blood, marriage or adoption and any ward of either unrelated person, living and cooking together as a single housekeeping unit, shall be deemed as constituting a "family."[1]
PERSON
Any individual, partnership, corporation or unincorporated association.

All dwellings, premises, homes, houses and apartments in the Incorporated Village of Atlantic Beach are restricted to one-family occupancy.
A. 
No person either as landlord, lessor, lessee or occupant of any dwelling, premise, home, house or apartment shall lease, permit or allow such dwelling, premise, home, house or apartment to be occupied by more than one family.
B. 
Penalties for offenses. Any person who shall lease, permit or allow such dwelling, premise, home, house or apartment to be occupied by more than one family shall be punished by and subject to a fine of not more than $500 or imprisonment for not more than 15 days, or both.[1]

A. 
No licensed real estate broker, agent or salesperson in the employ of a licensed real estate broker, shall cause a written lease to be executed by a landlord, lessor, lessee or occupant of any dwelling, premise, home, house or apartment in the Village of Atlantic Beach, to be occupied by more than one family.
B. 
Every licensed real estate broker, agent or salesperson in the employ of a licensed real estate broker, who procures such lease for a landlord, lessor, lessee or occupant of any dwelling, premise, home, house or apartment in the Village of Atlantic Beach, shall file with the Village Clerk of Atlantic Beach within 10 days of the execution of such lease, a true copy of the lease, or if the lease is oral, the name or names and address or addresses of the lessees and the substance of the letting agreement, together with the name or names and address or addresses of the lessors.
C. 
Penalties for offenses.[1]
(1) 
Every licensed real estate broker, agent or salesperson in the employ of a licensed real estate broker, who shall violate this chapter shall be punished by and subject to a fine of not more than $500 or imprisonment not to exceed 15 days, or both.
(2) 
Each day that a person violates this chapter shall constitute a separate and distinct violation and shall subject such person to the fine hereinabove stated.
