§ 39-1 Semiannual inspections of freight and passenger elevators.

A. 

The owners of all buildings in which elevators are installed shall arrange for competent inspections, by New York State approved inspectors, of passenger and freight elevators every six months.

B. 

A copy of such inspection must be posted in each elevator car, and an affidavit of inspection must be filed with the Building Inspector of the Village of the Branch within five days of the date of inspection.

C. 

The owners of all buildings in which elevators are installed shall immediately discontinue operation of any elevator found to be unsafe by such inspector, until corrective action is taken and the elevator is reinspected as provided for in Subsection A above and found to be safe for its intended use.

§ 39-2 Penalties for offenses.

A. 

Violations of the provisions of § 39-1A and C shall be punishable by a fine not to exceed $200 for the first offense and shall be punishable by a fine of not less than $200 nor to exceed $500 for all subsequent offenses.

B. 

Violations of the provisions of § 39-1B shall be punishable by a fine not to exceed $50 for the first offense and shall be punishable by a fine of not less than $100 nor to exceed $500 for all subsequent offenses.

C. 

Each day that a violation continues shall be deemed a separate offense.
