GENERAL REFERENCES

This chapter shall be known and may be cited as the "Economy Borough Park Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
PARK
Any playground, recreation center or any other area within the Borough of Economy, owned, used or operated by the Borough of Economy, devoted to active or passive recreation.
PERSON
Any person, firm, group, partnership, association, corporation, company or organization of any kind.
It shall be unlawful for any person in any park to willfully mark, deface, disfigure, injure, tamper with, displace or remove any buildings, tables, benches, fireplaces, railings, paving, waterline or other public utility, or parts thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or other boundary markers or other structures or equipment, facilities or appurtenances, whether real or personal.
No person shall throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream, bay or other body of water in or adjacent to any park or in tributaries, streams, sewers or drains flowing into such waters any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters; nor shall any person bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No such refuse or trash shall be placed in any waters or in a particular area of said park or shall be left on the grounds thereof, but it shall be placed in proper receptacles where these are provided. Where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person or persons responsible for its presence and properly disposed of elsewhere.
It shall be unlawful for any person to carry, possess or drink any alcoholic beverage or liquor in any park, with the exception of the pavilion behind the Municipal Building, by permit only.
Parks shall be open to the public every day of the year between sunrise and sunset. It shall be unlawful for any person, other than authorized Borough personnel, to occupy or be present in a park during any hours in which said park is not open to the public.
Permits shall be required for the use of parks, during any time the park is closed, by any group of five or more persons wishing to use a park for recreation or social purposes.
The fee for a permit shall be set from time to time by resolution of the Borough Council. Such fee shall be paid to the Borough at the time of submission of the application for such permit.
Any person desiring to secure a permit for use of a park shall complete and submit to the Borough Secretary an application at least 10 days prior to the date on which the applicant desires to use the park. Such application shall be in such form as the Borough may establish and shall contain the following information:
A. 
The name, address and telephone number of the applicant(s).
B. 
The name, address and telephone number(s) of all persons who will be using the park.
C. 
The date and time of the requested use.
D. 
The purpose of the requested use.
The Borough Secretary shall receive the application and accept the required filing fee and, if upon review of the application the same is in compliance with the requirements of this chapter and any regulations promulgated hereunder, shall issue the permit. The Secretary shall number the applications and permits in chronological order.
No permit issued hereunder shall be transferable by the permittee to any other person, nor shall the day or time of the requested use be changed without cancellation of the permit and issuance of a new permit upon application and payment of the required fee.
A. 
This chapter shall be enforced by the Economy Borough Police Department.
B. 
A person to whom a permit has been issued shall be bound by all park rules and regulations and all applicable ordinances as though the same were inserted in said permits.
Any person who shall violate any provisions of this chapter shall be liable, upon conviction thereof, to a fine of not more than $300 plus costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than 30 days, and further provided that each day's violation shall constitute a separate offense.
