[Adopted as Sec. 2:1 of the 1975 General Ordinances]
The title of this chapter shall be known and referred to as the "Administrative Code of the Township of Burlington."
For the purposes of this chapter, except as the context may otherwise require, the following terms shall have the following meanings:
ADMINISTRATOR
The Business Administrator duly appointed pursuant to the Charter and this chapter or the Assistant or Acting Administrator serving in the place of the Business Administrator pursuant to the Charter or this chapter.
CHARTER
The Mayor-Council Plan E Form constituting Chapter 210 of the New Jersey Law, 1950, N.J.S.A. 40:69A-1 et seq., as amended and supplemented, and any and all statutory provisions, administrative rules and regulations, or case law of the State of New Jersey as may be applicable to the municipality.
CLERK
The Municipal Clerk duly appointed pursuant to the Charter and this chapter.
COUNCIL
The local legislative body of the municipality constituted and elected pursuant to the Charter.
DEPARTMENT
An organization unit of the municipal government established or designated by or pursuant to this chapter as a department.
DIRECTOR
The administrative head of a department.
GOVERNING BODY
The Municipal Council as constituted under the Charter of the Township of Burlington.
INDEPENDENT BOARD, COMMISSION OR BODY
Any agency or instrumentality of the municipal government which is created by the Council by ordinance not allocated or assigned within a department.
MONTH
A calendar month unless otherwise specifically provided.
MOTION
Includes any act of the governing body dealing with procedural or parliamentarian matters not required to be reduced to writing, which may be finally passed at the meeting at which it is introduced.
MUNICIPALITY
The Township of Burlington within the County of Burlington and State of New Jersey or any corporate successor thereof.
ORDINANCE
Includes any act or regulation heretofore or hereafter adopted by the governing body required to be reduced to writing and read at more than one meeting thereof and published.
PERSON
Any corporation, firm, partnership, association, organization or other entity as well as an individual.
RESOLUTION
Includes any act or regulation of the governing body required to be reduced to writing but which may be finally passed at the meeting at which it is introduced.
WRITING and WRITTEN
Includes printing, typewriting and any other mode of communication used on paper or similar material which is in general use as well as legible handwriting.
YEAR
A calendar year unless otherwise specifically provided.
For the purposes of this chapter and any other ordinances which were heretofore or are hereafter adopted, except as the context may otherwise require, the following constructions shall apply:
A. 
The present tense includes the past and future tenses.
B. 
The masculine gender includes the feminine and neuter.
C. 
The singular number includes the plural and the plural, the singular.
D. 
The time within which an act is to be done shall be computed by excluding the first and including the last day, and if the last day be a Sunday or legal holiday, the day shall be excluded.
Within this chapter there are established a variety of positions appointed by various Township appointing authorities. It is the intent of this chapter that no appointment may be made without specific ordinance authorization for the position. However, any appointing authority, provided that there are funds available for the position, may by official action, whether it be by executive order, directive or resolution, establish a temporary position, which position shall be valid and capable of being temporarily filled if within three working days the Township Council shall enact an appropriate legislation, the intent of which is to establish the position to be filled.
Despite contrary provisions elsewhere herein contained and subject to prevailing provisions or state statutes and charter, the appointing authority may remove any member of an independent board or agency operating within the Township of Burlington where the appointing authority determines that said member had failed to attend three consecutive regularly scheduled meetings of said independent board or agency, said failure to attend constituting cause for removal.

A. 
The Township of Burlington Administrative Personnel Employee Handbook, adopted on February 24, 2004, and as may be amended from time to time, is hereby adopted and incorporated by reference as part of the Administrative Code of the Township of Burlington.
B. 
The Township of Burlington's Policies and Procedure Manual, Employee Handbook and Administrative Personnel Handbook are hereby amended for the purpose of adopting revisions and modifications to the following policies and procedures: Americans With Disabilities Act Policy; Contagious or Life-Threatening Illnesses Policy; Workplace Violence Policy; General Anti-Harassment Policy; Anti-Sexual Harassment Policy; Employee Complaint Policy; Anti-Retaliation Policy (new); Grievance Policy; Prompt Reporting of Complaints and Grievances Policy; Employee Discipline Policy; Resignation Policy; Attendance Policy; Breaks Policy; Telephone Usage Policy; No Expectation of Privacy Policy (new); E-Mail, Voice Mail, Computer and Internet Usage Policy; Social Media Policy (new); Paid and Unpaid Time Off Policy; Vacation Leave Policy; Sick Leave Policy; Family and Medical Leave Act Policy; Administrative Personnel Handbook; Longevity Pay; Insurance Buy Back (waiver); and Vacation Leave Policy.[1]

C. 
The Township of Burlington’s Employee Handbook, Employee Handbook Administrative Personnel and the Policies and Procedures Manual are hereby amended for the purpose of adopting the attached revisions to the following policies and procedures: "Communication Media Policy," "Worker’s Compensation Policy," "Early Closing and Delayed Opening Policy," "Domestic Violence Law Policy," "Family and Medical Leave Act Policy," "Resignation Policy"; in the Employee Handbook Administrative Personnel Handbook changes that were also made include Health Benefits after retirement and Health Benefits for Newly Elected Officials.[2]

The Township of Burlington's Employee Handbook, Employee Handbook Administrative Personnel and the Policies and Procedures Manual are hereby amended for the purpose of adopting the attached revisions to the following policies and procedures: "Anti-Discrimination Policy," "Americans with Disabilities Act Policy," "Communication Media Policy," "Open Public Records Act Section," and the "Drug and Alcohol Policy."[3]
