The prevailing Salary Ordinance of the Township of Burlington is hereby adopted as the pay plan for the Township of Burlington and shall be administered in accordance with its terms as hereinafter modified by this chapter.
Each individual holding a position within the government of the Township of Burlington shall be assigned a salary or rate of compensation within the salary range or compensation range established for the class of positions within which the position which the individual holds falls. The appointing authority shall advise, in writing, the individual of his rate of pay within 14 days of employment by the Township. When the individual attains the maximum rate for the position held as set forth within the Salary Ordinance, he shall not receive further salary increases, unless:
A. 
His position is reclassified.
B. 
He is promoted to another position having a higher salary range.
C. 
His position's salary range is increased.
D. 
A general salary increase is granted to all employees.
A new employee shall be paid at the minimum of the approved salary range set for the position to which he is appointed and shall not be entitled to any increase in compensation until his appointment has been made permanent in accordance with the procedure hereinafter adopted. This provision shall not apply to employees promoted to a new position or to employees whose positions are reclassified.
An employee demoted for disciplinary reasons to a classification having a lower salary range shall receive such compensation as the appointing authority shall specify, which salary shall not exceed the maximum step of the new range.
When a vacancy is filled by a temporary appointment, the employee shall be paid at the minimum of the approved salary range for the position. The length of a temporary appointment is governed by the policies of New Jersey civil service.
When an employee is reappointed within two years following a layoff to a position in the same classification, he will enter the position at the same step in the salary range as he received in his previous position.
When an employee is reemployed following a resignation in good standing to a position in the same classification, he will enter the position at the minimum rate of the salary range for the position.
An individual promoted to a position in a different classification than his initial position shall be paid at the minimum of the approved salary range or rate of pay set for the new position.
The salary or rates of pay for individuals whose positions are reclassified shall be determined in accordance with § 58-21 above.
If an employee transfers into another classification within the Township, he will not lose any vacation or sick leave credits. The salary or rate of pay of any individual who transfers into a position in another classification shall be determined by the appointing authority, but in no event shall it be greater than the maximum new title.
A. 
In accordance with the Pay Standards and Procedures in § 58-25 below, all police officers shall receive, as additional payment, $0.25 per week per college credit in only those courses which are directly related to police work, as determined by the Director of Public Safety, obtained by the police officer from an accredited college. Said payment is to be paid annually. In the event that statutory authority for state reimbursement to the Township shall be enacted during the period of this chapter, the aforesaid per-credit payment shall be increased to $0.50 per week per credit, as defined above, payable annually. The Township shall, whenever possible, agree to establish uniform procedures for assisting members of the Department to attend college or other schools to increase their efficiency and effectiveness as police officers, keeping in mind that primarily the operation of the Police Department is maintained.
B. 
If, after four years from January 1, 1994, the police officer has not successfully completed requirements for at least an associate's degree, all payments for college credits shall cease until the degree is achieved. If no bachelor's degree is achieved, the Township shall only pay for an associate's degree's credits plus a maximum of 20 credits. Should a master's degree be achieved, the Township shall pay for all credits the police officer has accumulated in reaching this degree. Those police officers hired after January 1, 1994, shall not be paid for any college credits until such time as a minimum of an associate's degree is achieved. Those police officers hired prior to January 1, 1994, shall have their college credits frozen at their amount as of December 31, 1994, and shall continue to be paid for them. Additional credits beyond this amount will not be paid until a degree is achieved. Proof of attainment of any degree is required in order to be eligible for payment.
A. 
Administrator. The Director of Public Safety for the Township of Burlington shall administrate the provisions of the college credit payment program for the Township, and in this regard, he shall:
(1) 
Establish a procedure within the Police Department which shall require any officer who desires to be paid under the provisions of this chapter to establish an approved curriculum whereby it can be determined that the police-related courses taken are pursuant to a program leading toward a degree in law enforcement. Those courses necessary in achieving a degree and not related to police work, as determined by the Public Safety Director, are deemed as ineligible for reimbursement under this chapter.
(2) 
Establish a procedure of certification whereby, upon the successful completion by an officer of an approved course, proof of this fact may be presented to the Public Safety Director, certified as accurate by the Public Safety Director, and transmittal made by the Public Safety Director at the conclusion of a calendar year to the Payroll Department for payment.
(3) 
Establish a recordkeeping procedure within the Police Department that will allow for an easy determination of the accumulative credits due an officer at any point in time.
(4) 
Establish with the Payroll Department a procedure to occur quarterly whereby the payments due to an officer may be determined and made part of the officer's official pay file; this procedure may include the preparation of forms, files or other devices to allow for the efficient and accurate maintenance of records.
B. 
Payroll Department duties. The Payroll Department shall annually pay to each officer an amount certified by the Public Safety Director to be the correct amount due for compensation under the provisions of this section of the Ordinance; this sum shall be equal to that set forth in § 58-24 of this chapter. Payments shall be made for each week following the date upon which the credit(s) were earned to the end of the calendar year, providing that proper certification has been received and verified by the Public Safety Director and transmitted to the Payroll Department.
C. 
Appeal. Any person who shall be aggrieved by the provisions of this chapter or seeks a review of the proceedings shall have a right within 10 days from the act complained of to appeal in writing to the Administrator of the Township of Burlington, who shall within 10 days from the date of receipt of the appeal schedule a hearing and within three days from the date of the hearing render a decision on the matter appealed either in writing or verbally. Such determination shall be deemed a final order and nothing contained within Article XIV of this chapter to the contrary shall survive.
