The owner of every existing house, building or structure, which is or may be occupied or used by human beings, located on a street along the line of any sewer now or hereafter constructed in the Township of Harrison, shall, within 90 days after the date on which the services of such sewer are made available to such house, building or structure install a toilet in such house, building or structure, unless a toilet is now installed therein or shall have been installed therein prior to such date and shall, prior to such date, connect such toilet therein or so installed therein with the sewerage system of the Township of Harrison.

The owner of every house, building or structure hereafter constructed, which may be occupied or used by human beings, located on a street along the line of any sewer now or hereafter constructed in the Township, shall, within 90 days after the date on which the services of such sewer are made available to such house, building or structure, whichever date shall be later, install a toilet therein and connect such toilet installed therein with the sewerage system of the Township of Harrison; and said connection and the soil pipe leading thereto and therefrom shall be either cast-iron or asbestos cement pipe, and the connection of the soil pipe to the sewer main or lateral shall be properly made in a good and workmanlike manner in accordance with standard plumbing practices.

If any such house, building or structure referred to in § 170-2 above shall be used for industrial or commercial purposes, the owner thereof, shall, within 90 days after the date on which the services of such sewer are made available to such house, building or structure, or prior to occupancy or use of such house, building or structure, whichever date shall be later, install such facilities as are necessary to accept and dispose of industrial wastes emanating therefrom and connect such facilities with the sewerage system of the Township of Harrison under and pursuant to rules and regulations as may hereafter and from time to time be adopted by resolution of the Township Committee for the Township of Harrison; and said connection and the soil pipe leading thereto and therefrom shall be either cast-iron or asbestos cement pipe, and the connection of the soil pipe to the sewer main or lateral shall be properly made in a good and workmanlike manner in accordance with standard plumbing practices.
If the owner of any house, building or structure referred to in §§ 170-1, 170-2 and 170-3 of this article shall fail to make any installation or connection required by this article within the time herein required, the Township may proceed to make such installation or connection, or cause the same to be made, and assess the cost thereof as a lien against such house, building or structure, pursuant to the applicable Revised Statutes of New Jersey.
The installations and connections required to be made pursuant to the provisions of §§ 170-1, 170-2 and 170-3 of this article shall be made in accordance with the Building and Plumbing Codes adopted or hereinafter adopted by the Township of Harrison, and the costs of connection shall be as established by resolution from time to time by the Township Committee of the Township of Harrison.

All cesspools, at such time or times when any house, building or structure is required to be tied in to the sewerage system, as provided for under this article, as amended, shall be required to be filled in with dirt or other suitable fill by the owner and/or tenant or person in possession of such premises, in violation of this provision shall be subject to the penalties provided for under this article.

The Board of Health members, or such other person as may be designated by the Board of Health, or the Township Committee, shall have the right to inspect any such property and/or properties which are subject to the terms of this article, as amended, to determine compliance with this article, as amended, and refusal to permit such inspection shall subject such property owner, tenants in occupancy, or other person in possession of such property to the penalties provided for under this article.

If the owner of any house, building or structure referred to in § § 170-1, 170-2 and 170-3 of this article shall fail to comply with the provisions of this article within the time herein required, in addition to other remedies provided for under this article, the Secretary of the Board of Health, or any member of the Board of Health, or such other Township official as the Township Committee may direct, may sign a complaint for violation of the provisions of this article, as amended, in the Municipal Court of Harrison Township, or such other court of jurisdiction in the matter. Upon conviction of a violation of this article, such person shall be subject to a fine not exceeding $1,250, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, and such person or entity shall be determined guilty of a separate violation for each and every day during which such violation shall continue after notice of the same.
