A. 
The Town Board, in order to prepare the Town for the next century and in the advent of upgrading of the town's computer systems and the ability to maintain more of the town's records on computers, it is the desire of the Town Board from time to time to analyze the operation and function of the Town and to reorganize and restructure the operations of the Town to be able to perform the town's function in a more efficient and economical manner and to deliver the required services to the taxpayers of the Town in a more efficient and simplified manner.
B. 
It is to this end that the Town Board has determined that certain administrative and operating departments of the Town should be merged into a single entity in order to effectuate this intent.
C. 
In enacting this chapter, the Town Board acknowledges that further amendments and enactments will be necessary in order to fully effectuate the intent and the desire of the Town Board to merge the four departments into one.
D. 
Additionally, in light of the fact that certain key staff members of the Town will be retiring between the enactment of this chapter and the end of calendar year 1998, it is the desire of this Board to look into the future and to streamline the operation of government and to prepare and plan for what occurs upon the retirement of the key personnel. It is to this end that the Town Board enacts this chapter.
A. 
There is hereby established, in the Town of Cortlandt, a Department of Technical Services.
B. 
Said Department will consist of those departments established by Local Law No. 2 of 1995,[1] Local Law No. 1 of 1984,[2] Local Law No. 3 of 1974[3] and Local Law No. 6 of 1992.[4]

The Director of Technical Services appointed herein shall be responsible for the coordination of those departments which are consolidated and merged herein. The position of Director shall be a classified and competitive position with the Westchester County Department of Civil Service, and the Director shall be appointed from a certified list as presented to the Town Board by the Director of Personnel of the County of Westchester. In addition to passing the Civil Service test as required, the Director shall also be a licensed professional engineer in the State of New York.

The operational divisions of the Department shall be Engineering Services, Water and Sewer Operations, Code Administration and Enforcement, and the activities of these divisions will be coordinated as the Director deems appropriate.

There is hereby created a position to be known as Deputy Director of Technical Services. The number of said Deputies shall be fixed by the Town Board. Said Deputies shall assist the Director in the day-to-day operations of the Department and shall supervise such activities of the Department or divisions of said Department as the Director and the Town Board shall deem appropriate. The position of Deputy Director shall be designated from the Town Board as budgetary requirements allow.

In addition to fulfilling the responsibilities as set forth in Chapters 77, 149, 31 and 104, the Department of Technical Services shall also facilitate and implement the following standardization of sharing of services as may be possible:
A. 
Sharing of support services.
B. 
Establishment of common records, where possible.
C. 
Standardization of application procedures.
D. 
Car pooling and coordinated use of vehicles and equipment.
Effective on April 1, 1996, the position of Animal Control Officer/Parking Enforcement Officer shall become a member of this Department. Initially, and until the enactment of further local laws, said Animal Control Officer/ Parking Enforcement Officer shall be under the direct supervision of the Director of Code Enforcement. And all of the functions of Animal Control (other than licensing) and parking enforcement shall become a duty of the Department of Code Enforcement. Nothing herein, however, shall prevent any police officer, employed by the Town or any other police agency having jurisdiction within the town, from issuing parking tickets for violations of any parking regulation effective within the Town of Cortlandt.

A. 
If any provision herein conflicts with any specific provision set forth in Chapter 31 of the Town Code of the Town of Cortlandt,[1] set forth in Local Law No. 1-1994, or Local Law No. 3-1974, or Local No. 6-1992, or Local Law No. 2-1995,[2] then the more specific provisions of the other local laws shall prevail and the provisions of this chapter shall not cause any conflict with those provisions and may be disregarded in the specific application herein.

B. 
The position of Town Engineer as set forth in Town Law § 20 and Chapter 31 of the Town Code as set forth as Local Law No. 1-1984[3] be and hereby is abolished.

C. 
This chapter shall supersede in their totality Public Officers Law § 3 as well as Town Law §§ 20 and 23 and any other provisions with respect to any of the duties or qualifications of the employees of this Department.
