The term of office of the elective Town Clerk of the Town of Cortlandt shall be four (4) years. Such four-year term shall commence on the first day of January following the first biennial Town election after the effective date of this article.
At the biennial Town election next following the effective date of this article and every four (4) years thereafter, the Town Clerk shall be elected for a term of four (4) years.
This article shall supersede, in its application to the Town of Cortlandt, Town Law § 24 with respect to the term of office of the elective Town Clerk.
This article shall be submitted for approval to the electors of the Town of Cortlandt at the next biennial Town election held not less than sixty (60) days after its adoption.[1]

This article shall take effect immediately upon filing with the Secretary of State after approval by a majority of the electors voting thereon in accordance with the requirements of Municipal Home Rule Law § 23.

The Westchester County Department of Civil Service has advised the Town Board that it interprets certain provisions of the New York State Town Law so as to require all employees in the Town Justice Court to be residents of the Town. While all of the full-time employees of the Justice Court are residents of the Town, the services of part-time employees, who are not residents of the Town, are employed by the Town Justice Court. It is with this in mind that the Town Board desires to vary the provisions of state law with respect to residency.
Employees of the Town of Cortlandt Justice Court need not be residents of the Town of Cortlandt, provided that they are residents of the State of New York at the time of their appointment and during the term of their employment.
Sections 20 and 23 of the Town Law and § 3 of the Public Officers Law be and hereby are superseded by the provisions herein in their application to the employees of the Town of Cortlandt who work in the Town Justice Court.
