Over the years the Town has relied upon private inspection agencies to perform electrical inspections within the Town. Over the years the New York Board of Fire Underwriters has been the sole provider of this service. Recently it has come to the Town's attention that the New York Board of Fire Underwriters is modifying its business and is withdrawing from the electrical inspection services area in Westchester County. It is with this in mind that the Town Board is desirous of amending certain local laws and ordinances of the Town to provide for the authorization of electrical inspection services by resolution of the Town Board whose inspections will be acceptable by the Department of Technical Services, Code Enforcement Division.

Additionally, since the County of Westchester has taken over the licensing of electricians and plumbers, it is appropriate to modify the codes of the Town to conform with said change in licensing. It is with all of these purposes in mind that the Town Board does hereby adopt this chapter.
On the effective date of this chapter, Chapter 191 of the Town Code of the Town of Cortlandt, specifically §§ 191-17 through 191-27, hereby are repealed.
The Director of the Department of Code Enforcement shall, as soon as practical, after the effective date of this chapter, require that a permit be attained by any electrical contractor and/or plumbing contractor performing electrical or plumbing work within the Town of Cortlandt. Said permit shall identify the property at which the work will be performed as well as the nature and substance of the work, identify the contractor and his license number and provide a process for the verification that the contractors liability insurance is in full force and effect. Said permit shall be kept as simple as possible.
Any fee to be obtained upon the issuance of a permit herein shall be determined on an annual basis by resolution of the Town Board.

The National Electrical Code, as from time to time amended, be and hereby is adopted. All electrical installations heretofore mentioned shall be made in conformity with the requirements of the National Electrical Code.

All plumbing installations within the Town shall conform to the requirements of the New York State Uniform Building and Construction Code and such other requirements of the state as may be in effect.
A. 
The Town Board shall from time to time adopt a resolution in which it will designate agencies who will be approved to conduct and make inspections and reinspections of all electrical installations heretofore and hereafter described and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections and reinspections be a charge against the Town.
B. 
Any inspection agency designated by the Town Board shall have as its duty to report in writing to the Director of Code Enforcement all violations of or deviations from or omissions of the electrical provisions of the National Electrical Code and all other regulations and rules. The inspectors shall make inspections and reinspections of electrical installations in and on properties in the Town of Cortlandt upon the written request of an authorized official of the Town of Cortlandt or as hereinafter provided. The inspector is authorized to make inspections and reinspections of electrical wirings and installations, devices, appliances and equipment in and on properties within the Town of Cortlandt where he/she deems it necessary for the protection of life and property. In the event of an emergency, it is the duty of the inspection agency to make electrical inspections upon the oral request of an officer of the Town of Cortlandt. It shall be the duty of the inspection agencies to furnish written reports to the proper officials of the Town of Cortlandt and owners and/or lessees of property where defective electrical installations and equipment are found upon inspection. The inspection agencies shall authorize the issuance of a certificate of compliance when electrical inspections and equipments are in conformity with this chapter and the National Electrical Code and shall provide a copy of the certificate of compliance to be sent to the Department of Code Enforcement.
This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to person or property caused by any defect therein, nor shall the Town of Cortlandt or any inspection agency herein be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.
The Town Board may by resolution appoint a Board to be known as the "Town of Cortlandt Electrical Board." It shall be the duty of said Electrical Board to meet and to provide input, comment and recommendations to the Division of Code Enforcement and the Town Board with respect to the administration of inspections of Electrical Installations and other items of interest to the electrical industry within the Town.
The Town Board shall appoint a Plumbing Board whose purpose shall be to meet as needed and to provide input, review and advice to the Division of Code Enforcement with respect to any issues concerning the plumbing trade within the Town of Cortlandt.
