The unincorporated territory of the Town of Cortlandt is hereby divided into the following classes of districts:
A. 
Residential districts. Residential districts are established in order to meet the housing needs of the present and future population of the Town and the region and to promote the stability and desirability of residential neighborhoods. Residential districts are established to provide and preserve neighborhoods containing detached single-family and two-family homes at a variety of densities and, where appropriate, multifamily dwellings pursuant to the provisions of § 281 of the New York State Town Law.[1] General residence districts provide for a broader mixture of single- and two-family homes. Residential districts are intended to be free from uses other than residential uses, except those which are both compatible with and convenient to the residents of such districts as set forth in this chapter.

B. 
Commercial districts.
(1) 
Community Commercial (CC) Districts. CC Districts are designed to provide shopping facilities and services for persons residing in immediately adjacent areas. The sizes of businesses are restricted in order to limit traffic volumes to a level appropriate to the character of the districts.
(2) 
Highway Commercial (HC) Districts. HC Districts are designed to accommodate automobile-oriented commercial facilities serving a wide area.
(3) 
Designed Commercial (CD) Districts. CD Districts are intended to provide a means for the establishment of well-designed, efficient and convenient retail shopping centers and complementary activities serving a wide area.
C. 
Industrial districts.
(1) 
Designed Industrial (MD) Districts. MD Districts are intended to permit and encourage industrial development and compatible commercial activities that will be so located and designed as to constitute a harmonious and appropriate part of the physical development of the Town, contribute to the soundness of the economic base of the Town and otherwise further the purposes set forth in § 307-2 of this chapter.
(2) 
Light Industrial (M-1) Districts. M-1 Districts are intended to provide a means for the establishment of industries and compatible commercial activities in appropriate portions of the Town.
(3) 
M-1A District.

D. 
Parks, Recreation and Open Space District (PROS). PROS is being established to ensure the preservation of publicly owned lands, including parks, open space, recreation areas, steep slopes, wetlands, flood-prone areas, unique, natural or geographic formations, rare vegetation or habitats of endangered wildlife, lakes, ponds, significant recreational areas or resources, trails, bikeways, pedestrian routes and significant scenic routes, particularly ridge lines, water bodies and mountains.

E. 
Aquifer protection districts. Aquifer protection districts are established to protect, preserve and maintain the water supply recharge areas within the Town so as to preserve present and potential sources of water supply for the public health, safety and welfare.
F. 
Conservation, recreation and open space districts (CROS). CROS Districts are established to protect and enhance environmentally sensitive and unique parcels to preserve their scenic, recreation, natural and aesthetic qualities consistent with the 2004 Comprehensive Master Plan.

G. 
Annsville Waterfront Enhancement District. The AWE District is established to aesthetically improve the Annsville Corridor by allowing uses to promote an attractive and revitalized commercial, residential, and mixed-use setting.

H. 
Medical-Oriented District. The MOD District is a mapped, overlay district including the existing New York Presbyterian Hospital Center and the abutting parcels to the west and the parcels located across from the hospital campus with frontage on Route 202/Crompond Road.

A. 
The boundaries of said districts, except the Aquifer Protection District, are hereby established as shown on the Zoning Map of the Town of Cortlandt dated September 14, 1993, which accompanies and which, with all explanatory matter thereon, is hereby adopted and made a part of this chapter. A copy of said map, indicating the latest amendments, shall be kept up-to-date in the offices of the Town Clerk and the Department of Planning and Community Improvement for the use and benefit of the public. The Zoning Map is subject to the condition of Town Board Resolution No. 276, adopted November 20, 1984, regarding property designated on the Town of Cortlandt Tax Maps as Section 24.09, Block 3, Lot 1, and Town Board Resolution No. 307-90, adopted November 16, 1990, regarding property designated on the Town of Cortlandt Tax Maps as Section 23.10, Block 4, Lots 42 and 46.
B. 
The Aquifer Protection District is an overlay district and shall be superimposed on other districts established by this chapter and shall include those areas within the Town of Cortlandt designated as Zones 2 and 3 on the map entitled "Zones of Groundwater Protection, Croton-on-Hudson, October 1988, Geraghty and Miller, Inc., Groundwater Consultants." Said map is hereby adopted and made a part of this chapter.
In determining the boundaries of districts shown on the Zoning Map, the following rules shall apply:
A. 
Where such district boundaries are indicated as approximately following the center line of streets, highways, waterways, aqueducts or railroad rights-of-way or such lines extended, such center lines shall be construed to be such boundaries.
B. 
Where such boundaries are indicated as approximately following property lines, such lines shall be construed to be such boundaries.
C. 
In all cases where a district boundary line is located not farther than 10 feet away from a lot line, such boundary line shall be construed to coincide with such lot line.
D. 
In all cases where a district boundary divides a lot and more than 50% of the area of such lot lies in the less restricted district, the regulations prescribed by this chapter for the less restricted district shall apply to such portion of the more restricted portion of said lot which lies within 30 feet of such district boundary.
E. 
In all other cases where dimensions are not shown on the Zoning Map, the location of boundaries shown on the map shall be determined by the use of the scale appearing thereon.
