GENERAL REFERENCES
Vehicles and traffic — See Ch. 200.
As used in this chapter, the following terms shall have the meanings indicated:
RECREATIONAL MOTOR VEHICLE
Includes but is not expressly limited to minibikes, motor-scooters, go-carts, motorbikes, dune buggies, golf carts, over-the-road motorcycles, mopeds and any other vehicle which is currently carrying a valid New York State license for operation and any other similar motor vehicle of the types that are normally used on land for recreation, entertainment or pleasure. The use of lawn mowers, powered garden vehicles, snowmobiles and other similar utilitarian domestic vehicles is specifically excepted herefrom.
A. 
Operational requirements. It shall be unlawful for any person to operate or permit, or allow or permit to be operated, a recreational motor vehicle as defined in § 201-1 within the Township of Hurley under any of the following circumstances:
(1) 
On other than the owner's property in the Town of Hurley, unless it is registered with the police having jurisdiction in the Town of Hurley and is identified with town-provided plates, unless said vehicle carries a valid registration.
(2) 
On any public grounds or property, including township-owned land, which shall include but not be limited to parks, ball parks, recreation areas, township-owned streets, easements and sidewalks, or areas dedicated to or commonly used for vehicular or pedestrian traffic, township storage facilities, garage areas and Board of Education lands, unless specifically designated, set aside and reserved therefor by resolution of the Hurley Town Board.
(3) 
In excess of the maximum permissive noise level of 110 decibels (dBA), as measured at one-half the manufacturer's specified revolutions per minute (RPM) engine limit at 20 inches from the tailpipe exit at a forty-five-degree angle on a stationary motorcycle in neutral gear. In the second year after enactment of the this chapter and thereafter, the maximum noise level permitted will be equal to or less than 105 dBA, as measured above.
(4) 
On lands of another or on private property, without the consent of the owner or lessee thereof. Any person operating a recreational motor vehicle upon lands of another in violation of this section shall stop and identify himself or herself upon the request of the landowner, his or her duly authorized representative or lessee and, if requested to do so by said landowner, representative or lessee, shall promptly remove said recreational motor vehicle from the premises.
B. 
Registration requirements. All registration and identification plates shall be subject to the following:
(1) 
The registration of said vehicle shall include the following:
(a) 
Name and address of the owner and/or principal operator of said vehicle.
(b) 
Year, manufacturer and model of the vehicle.
(c) 
Serial number of the vehicle.
(d) 
Inspection for compliance with the standards set forth in Subsection A(3) of this chapter.
(e) 
A registration fee as set forth from time to time by resolution of the Town Board.

(2) 
Identification plates must be attached to the vehicle in such a manner so as to not endanger the operator or passengers of the vehicle and which shall identify the vehicle for which it is issued for the period of its validity, and when it is operated on other than the owner's property, said plates must be kept clean and legible at all times. The registration is not transferable from owner to owner.
A. 
Law enforcement officials may inspect for compliance to this chapter upon personal observation and/or upon complaint from a resident. Measurement of noise levels will be made on site if violation of noise limit is suspected. New York State registered vehicles will be inspected in accordance with State Motor Vehicle Traffic Law.
B. 
Violations of this chapter will be, upon conviction, subject to a maximum fine of $25. A second violation and any subsequent violation will be subject to a maximum fine of $50 each.
