[Adopted 2-22-1971 by L.L. No. 1-1971 as Ch. 62, Art. IX, of the 1971 Code]
No person or persons, firm, association or corporation shall engage in or carry on the business of selling Christmas trees or storing Christmas trees without a permit from the Chief of the Fire Department, which permit shall not be granted unless such person or persons, firm, associations or corporations desiring the same shall comply with the following requirements:
A. 
Such person or persons, firm, association or corporation shall deposit with the Clerk of the Village of Rockville Centre the sum of $50. Such deposit shall be made to guarantee the removal of any trees, branches and accumulation of rubbish left on the premises on or before December 26 of the same year.
B. 
Upon completion of the removal of all trees, branches and accumulation of rubbish left on the premises, in accordance with the permit, to be evidenced by a certificate of the Fire Prevention Bureau, the Clerk of said Village shall return to said applicant the sum so deposited, less whatever expenses shall have been incurred by said Village for the removal of said trees, branches or accumulation of rubbish.
C. 
Each and every permit issued in pursuance of the terms and provisions of this article shall at all times be in the possession of the parties actually selling or storing Christmas trees.
D. 
In the event of the failure of the applicant to remove any trees, branches or accumulation of rubbish on or before December 26 of the same year, said trees, branches, accumulation of rubbish shall be removed by the Village of Rockville Centre and the costs thereof charged against the applicant.
E. 
No permit issued in pursuance of this article shall be construed to relieve any applicant for such permit of the duty to properly store and maintain said trees so as not to endanger property or interfere with the operations of the Fire Department or egress of occupants of the premises in case of fire.
F. 
Every application for a permit as herein provided shall be in writing and signed by the applicant, and it shall be the duty of the Clerk of the Village of Rockville Centre to have printed forms on which applications can be made (which forms shall contain a provision that in consideration of the granting of the permit, the applicant therefor shall save and keep harmless the Village of Rockville Centre from all damages caused by the negligence of the applicant).
