Village of Rockville Centre, NY Article IX Metered Parking Fields

[Adopted 2-22-1971 by L.L. No. 1-1971 as Ch. 124, Art. IX, of the 1971 Code]

§ 309-22 Installation authorized.

For the control of parking and traffic and the good and welfare of the Village, the installation, maintenance and operation of metered parking fields is authorized as more fully provided herein.

§ 309-23 Definitions.

The following words shall have the meaning herein indicated:

METERED PARKING FIELDS

Any place owned, leased or operated by the Village for the parking of vehicles by the public wherein the field or space in the field is so designated. Such designation shall be by means of signs to that effect in the fields or adjacent thereto or by parking meters adjacent to parking stalls marked or indicated by lines appearing on the pavement, within which a single vehicle is to be parked.

PARKING METER, VEHICLE, PERSON, OPERATOR and PARKING METER SPACE

Shall be the same as the definitions contained in § 309-28 of the Code of the Village of Rockville Centre.

§ 309-24 Provisions of Article X restated.

Sections 309-29, 309-30, 309-31, 309-32, 309-34, 309-35 and 309-36 of Article X of the ordinances of Rockville Centre are hereby included in this section as if they were restated in full.

§ 309-25 Parking time limits.

A. Parking or standing a vehicle in a designated space in a parking meter zone shall be lawful for the period indicated on the meter.

B. Said parking meters shall be operated from 9:00 a.m. to 6:00 p.m. in parking meter zones every day except Sundays and holidays.

§ 309-26 Penalties for offenses.

A. Any person who shall violate or fail to comply with any of the provisions of this article, or who shall counsel, aid or abet any such violation or failure to comply, shall be deemed guilty of disorderly conduct and shall be punished by a fine not to exceed $50 or by imprisonment not to exceed 30 days, either or both penalties to be imposed at the discretion of the court; provided, nevertheless, that should the violation consist solely of parking or standing a vehicle beyond the lawful time as is provided in § 309-25 of this article, upon due notification of such violation to the operator or owner of such vehicle, the payment of a fine in such amount and payable under such conditions as may be determined by the Village Justice pursuant to the provisions of Chapter 62 of this Code, with a plea of guilty, shall be considered settlement in full of any and all penalties hereunder; and provided, further, that the privilege of paying such fine shall be limited to an owner or operator who is guilty of such violation as a first offense. An operator or owner guilty of second or further violations shall be subject to the imposition of all the penalties as may be imposed by the Village Justice.

B. Failure to pay as hereby provided or to appear voluntarily in court will subject the operator or owner of such vehicle to a warrant for arrest and the imposition of such penalties as the law may provide.
