The Borough of Downingtown hereby imposes a fee, based on the usual, customary and reasonable costs incurred in the delivery of the service, for services provided by the Minquas Fire Company No. 2, Inc., and the Alert Fire Company No. 1 of Downingtown, Inc., or the Borough of Downingtown, or by their volunteers, staff, and affiliates, in providing fire-fighting personnel and equipment, fire suppression, emergency services and rescue services, traffic control and similar services for the protection of persons and property. The user fees for the services, personnel, supplies and equipment shall be based on estimated actual costs.
The fees shall be set by resolution of the Borough, and may be adjusted from time to time to reflect that which is the usual, customary and reasonable cost which includes any services, personnel, supplies and equipment. The user fees may be submitted to the insurance companies providing coverage regarding the incident. The resolution may take into account the benefits of membership in the organization providing the service, and may make adjustments for same.
The Borough Council may make such rules or regulations, and from time to time, may amend, revoke or add rules and regulations, consistent with this article, as it may deem necessary or expedient with respect to billing for these fees and/or the collection thereof. The resolution may also make provision for late fees, costs of collection, and related imposition.
All amounts collected as a result of this article shall be placed into a fund as established by the Borough Manager, after the deduction of administrative expenses, to be used exclusively for personnel, supplies and equipment for the Borough of Downingtown fire services.
