[HISTORY: Adopted by the Township Committee (now Township Council) of the Township of Logan 5-5-1998 by Ord. No. 6-1998. Amendments noted where applicable.]

§ 80-1 Purpose.

There is a need within the Township of Logan to provide residents with safe, secure public streets and meeting places and to protect the right of residents to use and enjoy their property and/or property to which the public is invited without unreasonable interference or disruption by activities proscribed by this chapter. This chapter is intended to meet this need and to provide guidance in its enforcement.

§ 80-2 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
PUBLIC
Affecting or likely to affect persons in a place to which the public or a substantial group has access; among the places included are highways, transport facilities, schools, prisons, apartment houses, places of business or amusement or any neighborhood.

C. 
Maintaining a nuisance. A person is guilty of a violation of this chapter when:
(1) 
By conduct which is either unlawful in itself or unreasonable under all the circumstances, he knowingly or recklessly creates or maintains a condition which endangers the safety or health of a large number of persons; or
(2) 
He knowingly conducts or maintains any premises or place where persons gather for purposes of engaging in unlawful conduct.

§ 80-4 Enforcement.

Any police officer or any special officer duly appointed by the Mayor and Township Council is hereby authorized and empowered to take into custody any such person who may be in the act of violating the provisions of this chapter.

§ 80-5 Jurisdiction of Municipal Court.

Under N.J.S.A. 2B:12-17 the Logan Township Municipal Court has jurisdiction over violations of municipal ordinances.

§ 80-6 Violations and penalties.

A. 
Upon conviction by the Logan Township Municipal Court of a violation of this chapter, a person may be sentenced to imprisonment for a definite term which shall be fixed by the Court and shall not exceed six months.
B. 
Persons convicted of a violation of this chapter and the offenses stated herein shall be subject to payment of a fine not to exceed $1,000 and court costs in addition to imposition of any sentence.
