Upon the enactment of parallel ordinances by
the Boroughs of Hopewell, Pennington and Princeton and the Townships
of Hopewell and Princeton, a Sewerage Authority is hereby created
pursuant to the Sewerage Authorities Law (N.J.S A. 40:14A-1 et seq.)
as a body politic and corporate under the name and style of the "Stony
Brook Regional Sewerage Authority."
The Sewerage Authority hereby created shall
have such functions, powers and duties as are provided by the Sewerage
Authorities Law, as amended and supplemented, and shall be governed,
administered and financed pursuant to that law and any other provision
of law applicable to such authorities.
The Authority shall consist of six members,
one to be appointed by each of the governing bodies, in accordance
with the provisions of the Sewerage Authorities Law, as amended and
supplemented.

The Township Clerk is authorized and directed to file forthwith a duly certified copy of this article with the Secretary of State of New Jersey and with the Municipal Clerk of each of the municipalities named in § 133-1.

This article shall take effect upon passage and publication pursuant to law and adoption of parallel ordinances by all of the municipalities named in § 133-1.
A.
Determination of findings. The Township does hereby
determine that it will be economical and otherwise advantageous to
it and to the residents and property owners of this Township for the
Township and the Stony Brook Regional Sewerage Authority to enter
into a contract providing for and relating to the treatment and disposal
of sewage and other wastes originating in this Township by means of
a sanitary sewerage system constructed by said Authority and the cost
and expense of such treatment and disposal; which contract, among
other things, shall obligate said Authority to proceed promptly with
the construction and placing in operation of said sewerage system
and obligate this municipality (together with various other parties)
to pay to said Authority such sums of money as may be necessary to
provide for deficits which might result from failure or disability
of said Authority to derive adequate revenues from the operation of
its properties, all substantially on the terms of the contract authorized
by this article.
B.
Execution of contract. The Township of West Windsor,
New Jersey, shall enter into a contract with the Stony Brook Regional
Sewerage Authority (and various other parties) providing for and relating
to the treatment and disposal of waste, on the terms and conditions
substantially in the form hereinafter referred to. The Mayor is hereby
authorized and directed on behalf of this Township to execute the
contract under the Corporate Seal of the Township, which shall be
affixed and attested by the Township Clerk, and to deliver the same.

C.
Form. The contract shall be in substantially the form
marked "Exhibit A - To Stony Brook Regional Sewerage Authority Municipal
Service Contract Ordinances of 1974" and now on file in the office
of the Clerk of this Township, and by this reference thereto made
a part of this article, and the terms and conditions thereof are hereby
approved and specifically agreed to.
