No person shall be, loiter or remain within the limits of any school property, school playgrounds, public parks or public playgrounds within the City of Pawtucket between the hours of 8:00 p.m. and 6:00 a.m. during Eastern standard time and between the hours of 9:00 p.m. and 6:00 a.m. during daylight saving time, except by special permission as provided in Chapter 294, Parks and Playgrounds, Article I, of the Code of the City of Pawtucket.
Any person violating the provisions of this article shall, upon conviction, be fined not more than $25.

It shall be unlawful for any juvenile under the age of 16 years to be, remain or loiter in, about or upon any place in the City away from the dwelling house or usual place of abode of said juvenile between the hours of 10:00 p.m. and 5:00 a.m. of the following day; provided, however, that the provisions of this section do not apply to said juvenile when accompanied by his or her parent, guardian or other adult person having the care, custody or supervision of said juvenile or where said juvenile is on an emergency errand or where said juvenile is on reasonable, legitimate and specific business or activity directed or permitted by his or her parent, guardian or other adult person having the care, custody or supervision of said juvenile.
It shall be unlawful for any juvenile 16 years of age or older and under the age of 18 years to be, remain or loiter in, about or upon any place in the City away from the dwelling house or usual place abode of said juvenile between the hours of 12:00 midnight and 5:00 a.m.; provided, however, that the provisions of this section do not apply to any emancipated minor or to a juvenile accompanied by his or her parent, guardian or other adult persons having the care, custody or supervision of said juvenile or where said juvenile is on an emergency errand or where said juvenile is on reasonable, legitimate and specific business or activity directed or permitted by his or her parent, guardian or other adult person having the care, custody or supervision of said juvenile.

All persons in violation of this article may be referred to either the Juvenile Hearing Board or the Family Court for adjudication, except that all persons in violation of the article who have never been previously arrested or whose arrests for violations of any state or municipal laws have resulted in either not guilty findings or dismissals may be referred only to the Juvenile Hearing Board for adjudication. Persons in violation of this article who have other matters pending before the Juvenile Hearing Board or the Family Court are not eligible for this exception.
