A.
The administration of this chapter shall be under
the immediate supervision and control of the Director of Zoning and
Code Enforcement. The Director shall be charged with:

The enforcement of this chapter as an effective part
of the City's urban housing improvement and urban renewal program.
(3)
The establishment and preservation of sound and stable
neighborhoods of decent, safe and sanitary structures by encouraging
the rehabilitation of substandard structures and premises and by effecting
conservation and improvement of basically sound neighborhoods.
(4)
The utilization of federal housing aids and financial
assistance for structure improvement.
B.
The Director may delegate any of his or her powers
or duties under the provisions of this chapter to any properly qualified
employee of the Division.
The Director is authorized to make surveys in
any area of the City to determine the general conditions of the structures
and premises in that area, the extent of deterioration and the lack
of facilities and maintenance, the unsafe and insanitary conditions,
the overcrowding which may exist and other matters included within
the provisions of this chapter.
The Director shall serve as the Hearing Officer and as such, shall be responsible for the scheduling, conduct and recording of hearings as provided for in Article III of this chapter, except that the Director may delegate these duties to any qualified employee of the Division.
Personnel of the Division shall, upon request,
exhibit clear identification whenever it shall be their duty to visit
buildings or premises for the purpose of making any survey, examination
or inspection.
Whenever the Director determines that the condition of a structure or premises or any part thereof is in violation of any zoning, building, fire or health ordinance or regulation adopted pursuant thereto, or any other ordinance or code or regulation of the City of Pawtucket governing the condition and improvement of buildings, which is not provided for by this chapter or which is provided for by a higher standard of such other ordinance, code or regulation, according to § 288-81 of this chapter, he or she shall refer such violations to the appropriate authority.
A.
The Director is hereby empowered to make and to adopt
such written rules and regulations as may be necessary for the proper
enforcement of the provisions of this chapter, to interpret and to
secure the intent thereof, but no such rules and regulations shall
be in conflict with the provisions of this chapter or any other ordinance
of the City or shall have the effect of waiving any provisions of
this chapter.
B.
Such rules and regulations shall have the same force
and effect as the provisions of this chapter, and the penalty for
violation thereof shall be the same as the penalty for violation of
the provisions of this chapter, as herein provided.
C.
Such rules and regulations shall be submitted to the
City Council. Failure of the City Council to approve, reject or modify
such rules and regulations within 90 days from the date of submission
shall be deemed to constitute approval thereof by the City Council.
Said rules and regulations as approved by the City Council shall be
published in a newspaper of general circulation in the City and shall
be effective 10 days after said publication.
