A.
Any person violating the provisions of § 182-16A(4) shall be guilty of a misdemeanor, punishable by a fine of not less than $300 nor more than $5,000 or by imprisonment for up to 30 days, or both.
B.
A violation of any other provision of § 182-16A of this chapter shall be punishable as follows:
(1)
For a first offense, by a fine of not less than $350 nor more than
$500 or by imprisonment for up to 15 days, or both.
(2)
For a second offense within a period of 18 months, by a fine of not
less than $500 nor more than $750 or by imprisonment for up to 15
days, or both.
(3)
For a third offense within a period of 18 months, by a fine of not
less than $500 nor more than $1,000 or by imprisonment for up to 15
days, or both.

This chapter shall be enforced by any duly constituted
law enforcement officer, including any Ordinance Enforcement Officer
or other Town department that may be constituted having jurisdiction
within the Town of East Hampton and/or by any Harbormaster of the
Town of East Hampton.
Should any section or provision of this chapter
be decided by a court of competent jurisdiction to be unconstitutional
or invalid, such decision shall not affect the validity of this chapter
as a whole or any part thereof other than the part so decided to be
unconstitutional or invalid.
