GENERAL REFERENCES
Public health nuisances — See Ch. 166.
As used in this chapter, unless the context clearly requires a different meaning, the following words and terms shall have the following meanings:
DEP
Department of Environmental Protection.
MONITORING WELL
A well installed at the request of the Board of Health to measure, by on-site instruments or laboratory methods in accordance with the provisions of N.J.A.C. 7:14A-1.1 et seq., the effect of land application of sludge/septage on Township water.
PCB
Polychlorinated biphenyl.
PERMITTEE
The holder of an authorization, license or equivalent document issued by the DEP for the land application of sludge and/or septage.
PERSON
Includes an individual, firm, corporation, authority, association, society or partnership and their agents or employees.
PPM
Parts per million.
SEPTAGE
The combination of liquid and solid residues resulting from the treatment of waterborne domestic waste in individual subsurface sewage disposal systems.
SITE
The land located in the Township of West Amwell where application of sludge or septage is authorized in accordance with a permit issued by DEP.
SLUDGE
The solid residue and associated liquid resulting from physical, chemical or biological treatment of wastewater.
No sludge or septage will be applied to any site in the Township of West Amwell by any permittee if the contents of said sludge or septage shall exceed the following limits:

A. 
At the request of the Township Board of Health, the permittee will cause to be installed, at the permittee's expense, monitoring wells on the proposed application site. The number of monitoring wells and their locations will be at the discretion of the Board of Health.
B. 
These wells will be monitored and tested periodically by the Township Board of Health in order to determine the existence of any substances which exceed the limits set forth in § 178-2 or which would otherwise cause pollution of Township waters. The cost of these tests will be paid for by the permittee.
The permittee shall notify the Township Board of Health at least 72 hours prior to application of its intent to apply sludge or septage to any site located within the Township. This notice shall be accompanied by a report setting forth the composition of the sludge or septage to be applied, together with the PPM and/or percentage of each element contained in the sludge and/or septage.
The permittee shall provide to the Township Board of Health quarterly reports setting forth the amount of sludge or septage applied on any site (by gallons) during the preceding quarter, the location of all application sites (by block and lot and property owner) and the composition of each application.
The provisions of this chapter shall be enforced by the Board of Health of the Township of West Amwell or its enforcing official.
Any person who violates or neglects to comply with any provision of this chapter or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not less than $100 nor more than $1,000 for each violation, to be collected and enforced by summary proceedings for the collection of the penalty pursuant to the Penalty Enforcement Law.[1]
