This chapter shall be known, and may be cited, as the "Town of Hamburg
Diesel Engine Control Code."
This chapter is adopted for the purpose of promoting the health, safety
and general welfare of the community and in furtherance of the following related
and more specific objections:
This chapter shall apply to all bus and truck diesel engines.
No person shall cause or permit any bus or truck diesel engine designed to transport people or merchandise and operating in the Town of Hamburg to idle more than 15 minutes in any one period when not in use performing its intended function as a source of power, except as permitted by § 93-5 hereof.
The prohibition contained in § 93-4 shall not apply when a vehicle is forced to remain motionless because of traffic conditions over which the operator has no control.
Any violation of any section of this chapter shall be deemed an offense
and upon conviction a person shall be subject to a fine of not more than $50
or imprisonment for not more than 15 days, or both.
If any clause, sentence, paragraph, section or part of this chapter
shall be adjudged invalid by any court of competent jurisdiction, such judgment
shall not affect, impair, or invalidate the remainder.
This chapter shall take effect immediately.
