As used in this article, the following terms shall have the meanings indicated:
IGNITION DEVICE
A match or matches, a lighter, or any other material when used for the purpose of ignition.
SCHOOL GROUNDS
The entirety of the buildings and campus of any public or private school located in the Village, inclusive of adjacent sidewalks and parking lots.
Except as provided in § 159-21, no person under the age of 18 years may possess any ignition device on school grounds.
Except as provided in § 159-21, no person may sell, give, deliver or make accessible any ignition device to a person under the age of 18 years on school grounds.
A person under the age of 18 years may possess or have access to ignition devices as may be required by, and under the supervision of, a teacher or school employee, but only while participating in class during school hours. A teacher or school employee may grant access to ignition devices to a person under the age of 18 as may be required by the curriculum, but shall ensure that the person does not remove the ignition device from the classroom.
Any ignition device possessed in violation of this article may be confiscated by any peace officer. Once confiscated, these ignition devices shall become the property of the confiscating authority and shall be kept accordingly as evidence in the commission of a violation of this article, or made inoperable and disposed of properly.
Any person who shall violate any provision of this article, or any regulation, rule or order made hereunder, shall be subject to a penalty as provided in Chapter 1, Article II, of this Municipal Code.
