A. 
The testing procedures in use by the Human Resources Division in the Office of the General Counsel to select applicants for City employment shall include the following:

(1) 
In the event that a selection panel is utilized to screen job applicants, each applicant who obtains a passing score and who is a resident of the City of Middletown will have an additional five points added to his final score.
(2) 
In the event that a written test and a selection panel are used to screen job applicants, each applicant who receives a passing score from both the written test and the selection panel and who is a resident of Middletown will have an additional five points added to his composite final score.
B. 
"Resident of Middletown" is hereby defined for the purposes of this section as being an individual who is permanently domiciled within the City of Middletown and actually resides within the City, and this residency requirement is not met by maintaining a mailing address or post office box within the City.

The following exempt, non-bargaining unit personnel, Police Chief, Deputy Police Chief(s), Fire Chief, Deputy Fire Chief, Director of Health, Director of Public Works, Director of Water and Sewer, General Counsel, Deputy General Counsel(s), Director of Parks and Recreation, Director of Finance and IT Coordinator, not having membership in any municipal union, are required to become permanent residents of the City of Middletown within one year of their appointment. Said residency requirement shall only affect individuals hired for those positions enumerated herein after the date of the adoption of this section. "Permanent residency" is hereby defined for the purpose of this section as being domiciled within the City of Middletown and actually residing within the City, and this requirement is not met by maintaining a mailing address or post office box within the City. The Common Council, by a two-thirds vote, may extend the compliance period not to exceed one year upon showing hardship. Failure of the appointed candidate to follow this section shall result in immediate termination.

A. 
Section 74-30 of the Middletown Code of Ordinances is hereby waived with respect to the appointment of J. Edward Brymer to the position of Police Chief for the City of Middletown. This waiver is not applicable to any future appointees to the position of Police Chief. In the event that J. Edward Brymer sells his permanent residence located in Wethersfield, he shall be required to comply with § 74-30 of the Middletown Code of Ordinances.
B. 
Section 74-30 of the Middletown Code of Ordinances is hereby waived with respect to the appointment of an individual to the position of Deputy Fire Chief for the City of Middletown. This subsection shall expire on October 30, 2005.
C. 
Section 74-30 of the Middletown Code of Ordinance requirements for Fire Chief Gary Ouellette are extended through December 31, 2007.

D. 
Section 74-30 of the Middletown Code of Ordinances is hereby waived with respect to the appointment of Thomas Tokarz to the position of Director of Human Resources for the City of Middletown. This waiver is not applicable to any future appointees to the position of Human Resources Director. In the event that Thomas Tokarz sells his permanent residence located in Cromwell, he shall be required to comply with § 74-30 of the Middletown Code of Ordinances.

E. 
The residency requirement of § 74-30 of the Middletown Code of Ordinances is hereby waived for Chief William McKenna. Hereafter, the Chief will report to the sitting Mayor and the Common Council on a biennial basis any changes to the circumstances underlying the Chief's original request for a waiver under this section. Based on Chief McKenna's biennial report of circumstances, the Common Council shall vote whether or not to continue said residency waiver. This waiver is not applicable to any future appointees to the position of Police Chief.

F. 
The residency requirement of § 74-30 of the Middletown Code of Ordinances is hereby waived for Police Chief Erik Costa to provide a limited twelve-month waiver, or until October 3, 2023. There shall be no further residency waiver for Police Chief Costa, and this waiver is not applicable to any future appointees to the position of Police Chief for the City of Middletown.

G. 
The residency requirement of § 74-30 of the Middletown Code of Ordinances is hereby waived for Deputy Police Chief Rich Davis for one year, or until February 6, 2024.
