A. 
All applications for permits required by the Connecticut Basic Building Code shall be made to the Building Division of the Public Works Department in accordance with the code.
B. 
All work for which a permit is issued shall conform to all applicable General Statutes, the Connecticut Basic Building Code and any other applicable state regulations and all applicable ordinances, rules and regulations of the City of Middletown.
C. 
All plans, other than those for single-family or two-family houses, shall be submitted to the Building Division on microfiche before a certificate of occupancy may be issued.

A. 
No permit for new construction for any building or structure requiring sewage disposal facilities shall be issued unless there is a public sewer available to the premises or a permit has been issued by the Health Department pursuant to and in accordance with the Public Health Code for construction of a sewage disposal system.
B. 
No permit for work to make an addition to any building or structure which reduces the lot area available for subsurface sewage disposal; for work to convert a building or structure for year-round use; or for work to change the use of an existing building or structure shall be issued unless there is a public sewer available to the premises or a permit has been issued by the Health Department pursuant to and in accordance with the Public Health Code.

A. 
No permit shall be issued until the required permit fee has been paid. The following permit fees are established pursuant to and in accordance with the Connecticut Basic Building Code and the General Statutes.
B. 
A separate permit shall be obtained for each building, structure or sign which is to be constructed, enlarged, altered, removed, relocated or demolished, and a separate permit shall be obtained for each trade for each building or structure for electrical, elevator, plumbing and heating, air conditioning and refrigeration and oil burner.
C. 
The fee for each permit shall be based on the cost as herein specified, sworn to by the owner or his representative, or as estimated by the Building Official as provided herein, and shall be as follows:

D. 
The owner or his agent or contractor shall submit with the application for a building permit an estimated cost of the entire sign, building or structure and site improvements, including all materials and labor. Cost shall include all work by all crafts required to complete the sign, building or structure and site improvements in preparation for a certificate of occupancy. If said estimated cost, in the opinion of the Building Official, is not a reasonable estimate of cost, the Building Official shall determine the estimated cost based on current construction costs for all labor and material, and the fee for the permit shall be based upon such estimate made by the Building Official.
E. 
The Common Council may waive the permit fee for nonprofit corporations or organizations; provided, however, that such nonprofit corporations or organizations shall remit to the Building Official the education fee which said Official is required to assess and remit to the State Department of Public Safety pursuant to C.G.S. § 29-263, as amended.
F. 
No permit fee shall be paid by any City agency to obtain a permit from the Building Official for construction by the City upon property owned by the City for use by the City.
G. 
Separate permits shall be required for each building or structure, whether or not such building or structure is connected to another building or structure by a tunnel, canopy, walkway or other connecting structure.
A. 
Filing bond. No person shall erect, install, remove or rehang any sign for which a permit is required under the provisions of the Connecticut Basic Building Code and which encroaches on any street, highway, alley or other public way until a surety bond in the amount of $10,000, with an insurance company authorized to do business in this state as surety, has been filed with the Building Division of the Public Works Department as herein required.
B. 
Conditions of bond. The bond shall be for the purpose of indemnifying and holding the City harmless against any and all liability for injury to persons or property that may occur by reason of the construction, erection or maintenance of the sign. Such bond shall be conditioned on the construction, erection and maintenance of the sign in accordance with the provisions of the Connecticut Basic Building Code and shall protect and save the City of Middletown harmless from any and all liability, claims, damages, expenses or demands for personal injury or property damage by reason of the construction, erection or maintenance of the sign, including but not limited to personal injury or property damage resulting from defects in construction or the collapse or failure of any sign or any part thereof.
C. 
Notice of cancellation. The surety bond herein required shall remain in full force and effect during the life of the sign and shall not be canceled by the principal or surety until 30 days after receipt of written notice of cancellation by the Building Official. If any bond to be canceled is not replaced within 10 days of notice to the Building Official, he shall order the sign removed.
D. 
Liability insurance. No permit shall be issued for the erection, installation, removal or rehanging of any such sign until there has been filed with the Building Division a certificate of insurance, from an insurance company authorized to do business in this state, certifying that the person or persons to perform the work have in force public liability insurance in an amount not less than $150,000, which certificate shall also state that 30 days' prior written notice shall be given to the Building Official of a cancellation or other change in coverage of such policy.
The fire districts are established pursuant to and in accordance with the Connecticut Basic Building Code as required by the code and General Statutes.

Fire District No. 1 shall comprise the areas housing highly congested business, commercial, manufacturing and industrial uses or in which such uses are developing. No building or structure shall be moved in, upon or over any public highway within the City without a written permit first being obtained from the Director of Public Works. A permit fee shall be paid in accordance with the schedule in § 120-3 based upon the cost to move the building or structure over the highway.
All awnings shall be installed, constructed and maintained in accordance with the provisions of the Connecticut Basic Building Code. The Department of Public Works shall annually inspect all awnings to determine whether they conform to the provisions of the Connecticut Basic Building Code and, in the event they do not so conform, shall notify the owner or person maintaining the same and order him to make such changes necessary to conform to the code.
A. 
Upon receiving a building permit, the party intending to build shall, if the street in front of the proposed building is not graded, obtain the necessary information as to the grade from the Department of Public Works of the City of Middletown and build in conformity therewith. It is the responsibility of the owner to determine the proper grade. The Building Official has no responsibility to determine proper grade. If he issues a permit for construction shown on a set of plans upon which incorrect grades are indicated no responsibility shall attach to the Building Official and it shall not excuse a failure to build according to proper grade.
B. 
It is the owner's responsibility to build in such a manner as to take into account any and all drainage patterns affecting the property.
C. 
All plot plans are required to show the finished first floor elevation and the elevation of the center line of the pavement of any adjacent highway or street.
D. 
All proposed buildings are required to have a minimum elevation of two feet for the finished first floor above the existing or proposed street pavement wherever possible. Whenever conditions do not permit adherence to this requirement, a final grading plan must be submitted showing all underground and surface drainage necessary to accommodate any future runoff from and to adjoining areas. Any required modifications or additions to an existing roadway or drainage system shall be the responsibility of the owner and shall be shown on the plot plan prior to the issuance of a building permit. No modification or addition to an existing roadway or drainage within the street line or any area in which the City has the right to drain, by easement or otherwise, shall be made without first obtaining a written permit from the Department of Public Works. In any event, the City shall not be obligated to make modifications or additions to any roadway or street or drainage system to alleviate any drainage problem created by the builder or owner, whether or not any permits have been obtained from the City.
A. 
The plot plan submitted with an application for a building permit must be prepared by a Connecticut registered land surveyor bearing the seal of the surveyor and a certification that it is substantially correct to the degree of accuracy shown thereon. The plot plan must display all zoning information pertinent to front, rear and side yard requirements, as well as other information required by any applicable statute, regulation or ordinance.
B. 
Initially, only construction of the foundation will be authorized. After completion of the foundation a recertification must be made by the surveyor on the plot plan certifying the exact location of the foundation as built. After such recertification has been made to the Building Official, and the Building Official determines that the location as recertified is in compliance with required zoning laws, approval will be given for completion of construction.
A. 
The Director of Public Works or the Building Official shall have the authority to inspect, as to nonresidential property during normal business hours and as to residential property between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday, except in the event of an emergency when entry is necessary in the interest of public safety, in which event inspection may be made at any time, any electric wiring, apparatus, material or appliance now existing or which may hereafter be installed or which is offered for sale in the City.
B. 
When any such wiring, apparatus, material or appliance is found by the Director or Building Official to be hazardous to life or property or to cause interference with radio reception or when any apparatus, material or appliance offered for sale or any work installed subsequent to the adoption of the State Building Code or any applicable ordinance is found not to be in compliance therewith, the person responsible for the maintenance, installation or offering for sale of the same shall be notified and a period of time specified within which any such wiring, apparatus, material or appliance shall be put in an approved condition or removed or withdrawn from sale, as the case may be. Upon the failure of any person to comply with the requirement set forth in any such notice, the Director or Building Official may disconnect or may order the disconnection of electric service to any wiring, apparatus or appliance covered by the notice.
No electric meters or services within or attached to any building which have been removed or disconnected for any reason whatsoever shall be reinstalled or reconnected without the approval of the Building Official. In the event that the electrical system which the meter or service serves consists of knob or tube, open wiring, wooden molding or cleat work wiring, the systems, including meter boards, shall be removed and replaced with materials conforming to the Connecticut State Building Code.
Wiring to oil burners shall be independent of other branch circuits. Each burner shall have a thermostatic safety control and two identified switches controlling the burner, these switches to be in series of the "hot wire," one located near the burner and one near the entrance to the room in which the burner is located. The locations of the safety control and switches shall be subject to the approval of the Building Official.
All lights on exterior fire escapes shall be equipped with suitable lock guards.
In public buildings, hotels, dormitories and elsewhere as may be required for the public safety and welfare, there shall be placed at each exit or passage to an exit a permanent exit sign of a type and in a location approved by the Director of Public Works or Building Official.[1]
