This article shall apply to all structures containing three or more dwelling units, all hotels, motels, lodging houses, rooming houses and dormitories.
It shall be the responsibility of the owner and the operator of each property covered by this article to maintain all smoke detectors and warning equipment in good working order. This requirement applies to all smoke detectors and warning equipment which are required to be installed by any state or federal law in the premises referred to in § 161-38 of this article, unless the responsibility for maintenance is required of some other person by any state or federal law, in which case the state or federal law shall apply.
Between January 1 and January 31, 1983, and during January of each year thereafter, the owner or operator of each structure covered by this article shall certify to the appropriate Fire Marshal, in writing, that the required maintenance has been performed on all smoke detectors and that the devices are in good working order as of the date of the certification.
