The enactment of this chapter is not intended as an exercise of any power of the City or the City Council but rather to establish, in a public document, the independent legal status of the Board of Trustees of the Lebanon Library under RSA Chapter 202-A. For this purpose, the chapter specifically provides for the agreement of the Lebanon Library Board of Trustees. The provisions of this chapter are intended to be a declaration of applicable state law as to the operation of the Lebanon Library and the Lebanon Board of Trustees.[1]

The Lebanon Library Board of Trustees consists of seven members and up to three alternate members who shall be elected as provided in RSA 202-A:6 and 202-A:8. Any vacancy occurring among the elected members of the Board of Library Trustees shall be filled by the City Council as provided in RSA 202-A:10. Alternate members shall sit on the Board during meetings which regular members are unable to attend. Alternate members shall be appointed to one-year terms.
The Library Trustees shall have the powers and duties set forth in RSA Chapter 202-A. The Library Trustees shall set all fines and payments for late return of books and/or periodicals and payments for lost or damaged books.

The Director of the Library and all library employees shall be hired by the Library Trustees. The terms and conditions of their employment shall be determined by the Library Trustees with the exception of those positions set by the contract between the City and the Lebanon Professional and Salaried Employees Association (LPASE). The Library Trustees may adopt personnel rules and regulations. All library employees shall be paid by the City and covered by the City’s health insurance (as may be eligible), worker’s compensation, unemployment compensation and any other provisions applicable to City employees. All payment by the City to the library employees shall be chargeable to the library’s appropriation.
Consistent with past practice, the City will maintain and repair the library buildings and grounds. In addition, the library buildings and grounds and library employees will be covered by the City's insurance, including casualty insurance and liability insurance. Maintenance will include janitorial services at the two library buildings. Any major public improvements to the buildings and grounds will be part of the City's capital improvement program. All expenses incurred for these purposes will be part of the City budget and will not be chargeable to the library's annual appropriation.
The Trustees of Trust Funds shall pay over to the Library Trustees annually, in accordance with state law, all income derived from funds held by the Trustees of Trust Funds for the Lebanon Library. Such income shall not be paid into the City general fund. As provided by RSA Chapter 202-A, all gifts and bequests directly to the library will be held by the Library Trustees.

The Library Board of Trustees will authorize all sums to be paid from the annual library's appropriation. Any unexpended balance of the library's annual appropriation will be carried over and made available for expenditure by the Library Board of Trustees in the next fiscal year. Such unexpended balance of the annual appropriation shall not lapse and shall not be paid into the City general fund.
