GENERAL REFERENCES

Except in necessary defense of person and property, and except as provided in § 326-3 of this chapter, it shall be unlawful for any person to use, fire or discharge any gun or other firearm within the Borough of Lansdowne.

Except when authorized in a private home by the owner of such home, it shall be unlawful for any person to discharge any air gun, air pistol, spring gun, spring pistol, BB gun, BB pistol, pellet gun, pellet pistol, CO2 gun, CO2 pistol, any device which impels a projectile of any kind, bow and arrow, blank gun, blank pistol, starter pistol or replica model or fake pistol or gun in the Borough of Lansdowne.
This chapter shall not apply to:
A. 
Any law enforcement officer when used in the discharge of his official duties.
B. 
Members of any organization duly conforming to the laws of the Commonwealth of Pennsylvania relating to target shooting upon the grounds or property belonging to or under the control of such organization.
Any police officer of the Borough of Lansdowne is hereby authorized to seize, confiscate and remove any item used, discharged or displayed in violation of this chapter. The Chief of Police of the Borough of Lansdowne is hereby authorized to destroy any such item so seized.

Any person who shall violate any provision of this chapter shall, upon conviction in a summary proceeding before a Magisterial District Judge, be sentenced to pay a fine of not more than $1,000 and costs of prosecution and, in default of payment of fine and costs, shall be sentenced to imprisonment for not more than 30 days.
