Any contractor applying to the Borough of Mount Oliver for a building
permit for any purpose shall present proof of workers' compensation insurance
or an affidavit that the contractor does not employ other individuals and
is not required to carry workers' compensation insurance.
Every building permit issued by or on behalf of the Borough of Mount
Oliver to any contractor required to carry workers' compensation insurance
shall clearly identify the workers' compensation policy and the contractor's
federal or state employer identification number in addition to any other information
required by municipal ordinance or regulation. If the building permit is issued
to an applicant which affirms that it is not obligated to maintain workers'
compensation insurance under this Act, the permit shall clearly set forth
the contractor's federal or state employer identification number and the substance
of the affirmation and shall further state that the applicant is not permitted
to employ any individual to perform work pursuant to the building permit.
The Code Enforcement Officer or Building Inspector shall, prior to issuing
a building permit, require submission of a certification that the Borough
of Mount Oliver is named as a workers' compensation policy certificate holder
for the purposes of the issued building permit. This certificate shall be
filed with the Borough of Mount Oliver's copy of the building permit. Any
insurer issuing a policy and naming the Borough of Mount Oliver as a workers'
compensation policy certificate holder pursuant to this section shall notify
the municipality of the expiration or cancellation of any such policy of insurance
or policy certificate within three (3) working days of such cancellation or
expiration.
The Code Enforcement Officer or Building Inspector of the Borough of
Mount Oliver shall issue a stop-work order to any contractor who is performing
work pursuant to a building permit, upon receiving actual notice that the
contractor's workers' compensation insurance or state approved self-insurance
status has been canceled.
If the Code Enforcement Officer or Building Inspector of the Borough
of Mount Oliver receives actual notice that a permittee, having filed an affidavit
of exemption from workers' compensation insurance, has hired persons to perform
work pursuant to a building permit and does not maintain required workers'
compensation insurance, the Code Enforcement Officer or Building Inspector
shall issue a stop-work order which shall remain in effect until proper workers'
compensation coverage is obtained for all work performed pursuant to the building
permit.
Any contractor violating any provision of this Article shall indemnify
the Borough of Mount Oliver for costs and expenses incurred by the Borough
of Mount Oliver in enforcing these sections and shall, in addition, be liable
for any statutory penalties provided by law.
