As used in this chapter, the following terms shall have the meanings
indicated:
Includes the words construct, reconstruct, alter, enlarge, move and
establish.
Includes a partnership, corporation or other legal entity.
Being shown upon a plan duly approved by the Planning and Zoning
Commission.
Includes the words Town street, Town road, proposed Town highway,
proposed Town road and proposed Town street.
No person shall hereafter build any driveway abutting or adjoining a
Town highway before first filing a written application and a filing fee of
$10 with the Public Works Office of the Town of Bethel and having a written
permit to proceed with the work from said office.
After securing said permit, the area from the existing and/or proposed
paved or traveled portion of the Town highway to the applicant's property
line shall be constructed in the following manner:
A.
Said area shall be excavated to proper depth and have
a gravel base of bank run gravel or broken stone of no less than six inches
in depth.
B.
It shall have a surface of two inches of bituminous concrete
and shall be so shaped that the water from the applicant's property shall
drain into the existing gutter abutting said driveway on the public highway.
C.
The driveway entrance shall be so shaped that the gutter
line of the Town highway shall be maintained in a true line and grade.
D.
If unusual drainage conditions exist, the construction
must conform to any special requirements which the Public Works Commission
or Director may specify.
A.
If said application is granted by the Town, the excavation
shall be made under the supervision of the Public Works Commission, or its
duly authorized agent.
B.
The person making the driveway opening shall guard and
protect the opening for the protection of all persons using said road and
shall be responsible for all damages which any person may sustain because
of or on account of said opening.
C.
Said person shall restore the Town highway to its former
condition as near as is practical, at his own expense, to the satisfaction
of the Public Works Commission.
A.
A performance bond shall be posted with the Public Works
Office to guarantee completion of the work set forth in the application. In
no event shall the bond be less than $300 in amount. Said bond shall be released
after the work has been satisfactorily completed.
B.
The performance bond shall be in cash or certified check.
Driveway permits will be issued for a one-year time period. If the driveway
is not completed within this time, a new application and fee must be filed
and a permit issued.
Any person who shall violate any of these provisions shall be fined
not less than $100 for each day said violation continues.
