On or after the effective date of this chapter, disposable solid waste shall be deposited at the solid waste transfer station located at the former Bethel sanitary landfill and shall comply with all requirements of the rules and regulations of the Bethel Public Works Commission and the Connecticut Department of Environmental Protection.
As used in this chapter, the following terms shall have the meanings indicated:
SOLID WASTE
Unwanted or discarded waste materials in a solid or semisolid state, including but not limited to garbage, street refuse, rubbish, animal and agricultural waste, but excluding chemical toxics and hazardous wastes, excessive demolition waste, ashes, tree stumps and tires. Said definition shall be subject to modification from time to time by the Board of Selectmen of the Town of Bethel.
No person, firm, corporation, business, partnership or other entity shall deposit refuse, garbage or sludge at the Bethel sanitary landfill and/or transfer station site, unless said refuse, garbage or sludge originates or comes from within the corporate limits of the Town of Bethel.

A. 
In order to obtain an annual commercial or semicommercial haulers permit, the owner or lessee or an officer (identified and authorized as to title) of the owner or lessee of each commercial or semicommercial vehicle engaged in the disposal of wastes at the transfer station site shall be required to register with the Public Works Department of the Town of Bethel on a form provided by it disclosing to said Department the information set forth in § 93-6 below and by payment of a fee in effect and set from time to time by the Board of Selectmen for those vehicles classified as commercial haulers and vehicle semicommercial haulers.[1] For the purpose of this chapter, semicommercial vehicles shall be classified at the designation of the Public Works Director or his assignee. The applicant shall further be required to sign an affidavit of origin, under penalty of false statement, that all solid waste hauled to the Bethel transfer station originates or comes from within the corporate limits of the Town of Bethel and shall provide a list of its routes to the Director of Public Works.

B. 
No commercial or semicommercial vehicle shall be permitted access to the Bethel transfer station unless a valid permit sticker is displayed on said vehicle. Such permit stickers may be obtained at the Bethel Municipal Center after registration as required herein and shall neither be assigned nor transferred by the holder thereof.

Noncommercial permits shall be provided annually to residents or taxpayers of the Town of Bethel who shall be permitted to dispose of solid wastes at the Bethel transfer station site, provided that no vehicle shall be permitted access to the Bethel transfer station site unless a valid noncommercial permit sticker is displayed on said vehicle. Such permit stickers shall be provided annually to taxpayers under direction of the office of Public Works of the Town of Bethel and may be obtained at the Bethel Municipal Center on proof of residence, or taxpayer status, and by payment of the fee in effect as set, time to time by the Board of Selectmen.[1] Such permit stickers shall neither be assigned nor transferred by the holder thereof.

The commercial and semicommercial registration form and affidavit of origin shall be as follows.[1]

A. 
In addition to the annual permit fee, each commercial and semicommercial hauler shall pay a use charge for each utilization, based on the cubic yardage of each vehicle:
(1) 
Commercial haulers: $0.50 per cubic-yard capacity.
(2) 
Semicommercial haulers: $0.50 per cubic-yard capacity.
B. 
The Board of Selectmen and/or its delegates shall establish and control the method of payment of said fees.
From and after the effective date of this chapter, any person, firm, corporation, business, partnership or other entity may be refused access to the Bethel transfer station site where the compliance with this chapter has not been effected.
Any person who violates any provision of this section shall be fined the sum of $100 for each offense.
The Public Works Department may, from time to time, designate certain areas or storage bins located within the area of the transfer station or at certain designated points within the Town of Bethel for the disposition of recyclable materials, such as newspapers, cans, bottles and discarded scrap metal products. Said areas or storage bins shall only be for the disposition of materials designated thereon and for no other.
The Board of Selectmen of the Town of Bethel shall have the power, from time to time, to increase or decrease the fees and charges set forth in §§ 93-4, 93-5 and 93-7 of this chapter and to establish and enforce reasonable rules and regulations regarding the operation and use of the Bethel transfer station. Such increases, decreases and the establishment of rules and regulations shall only be accomplished by the Board of Selectmen upon its affirmative vote after holding at least one public hearing, duly warned, for public input regarding the proposed action by said Board.

A. 
Permits will be issued on an annual basis to coincide with the Town of Bethel's fiscal year, commencing on July 1, 2011.
B. 
Any permits issued on or after June 1, 2010, shall remain in effect and shall be honored at the Bethel solid waste transfer station through June 30, 2011. Any permits issued prior to June 1, 2010, shall expire on June 30, 2010.
The passage of this chapter shall, upon its effective date, repeal in its entirety the ordinance regarding solid waste disposal, effective January 12, 1981.[1]
