The purpose of this chapter is to provide for the public's health, safety and welfare by setting forth regulations governing the emissions from operating mobile sources pursuant to the authority of Chapter 98, Municipal Powers, Section 7-148 et seq. of the Connecticut General Statutes, as amended.
As used in this chapter, the following terms shall have the meanings indicated:
MOBILE SOURCE
A source designated or constructed to move from one location to another during normal operation, except portable equipment, and includes but is not limited to automobiles, buses, trucks, tractors, earth-moving equipment, hoists, cranes, aircraft, locomotives operating on rails, vessels for transportation on water, lawn mowers, snow blowers and other small home appliances.
No mobile source engine shall be allowed to operate for more than 10 minutes when the mobile source is not in motion, except as follows:
A. 
When a mobile source is forced to remain motionless because of traffic conditions or mechanical difficulties over which the operator has no control.
B. 
When it is necessary to operate heating, cooling or auxiliary equipment installed on the mobile source when such equipment is necessary to accomplish the intended use of the mobile source.
C. 
To bring the mobile source to the manufacturer's recommended operating temperature.
D. 
When the outdoor temperature is below 20º F.
E. 
When the mobile source is being repaired.
Subsections A through E of § 105-3 of this chapter shall not apply to aircraft, locomotives operating on rails, vessels for transportation on water, lawn mowers, snow blowers and other small home appliances.
A. 
Enforcement of this chapter shall be the responsibility of the Chief of Police and whomever he may delegate the same to within the Police Department of Bethel.
B. 
Any operator of a mobile source who violates the provisions of this chapter shall be fined the sum of $50 for each such offense, payable to the Police Department of Bethel within 14 days of said violation. Failure to pay said fine within the designated time period shall result in additional penalty of $10 for each violation.
