[HISTORY: Adopted by the Town Board of the Town of Cortlandville 6-21-1955. Amendments noted where applicable.]
No circus, carnival or road show, rodeo, horse show or wild west show, auto race, dog show menagerie, tent show, fireworks display, club fair, clambake or outdoor entertainment, performance or exhibition of any kind, where admission is charged or which is conducted for gain or profit, shall hereafter be conducted or operated within the Town of Cortlandville without a license first having been issued therefor by the Town Clerk pursuant to § 137 of the Town Law; provided however, that this section shall not apply to amateur athletic contests or other amateur performances or exhibitions.
All applicants for licenses hereunder shall submit a written application therefor supplying such information under affidavit as the Town Board may from time to time by rule or regulation require.
License fees shall be as set forth from time to time by Town Board resolution.

Upon receipt of the license fee therefor, and provided that, in the judgment of the Town Clerk, the applicant therefor is not an undesirable person or incapable of properly conducting the show, performance, exhibition or entertainment for which a license is desired, or shall not have been convicted of a misdemeanor or felony which in the judgment of the Town Clerk renders the applicant unfit or undesirable to carry on such show, performance, exhibition or entertainment, and provided further that the indemnity bond or insurance policy or a certificate of the insurance thereof in the amount of at least $100,000 in the case of a circus, carnival or road show and $20,000 in the case of every other kind of show, performance, exhibition or entertainment, indemnifying any person or persons against any and all liability for damages in connection with such show, performance or exhibition, or entertainment be filed simultaneously with such application, the Town Clerk shall issue the appropriate license desired, which license shall become effective from the date of issuance and shall continue in force for the term specified therein, but in no event for a longer term than until the first day of January next succeeding. Such license shall not be transferable.
Anyone violating any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $250 or by imprisonment for a term of not more than 15 days, or by both such fine and imprisonment.
