[Adopted 11-6-1963 by Ord. No. 3527 (Article 3A of Chapter 18 of the Revised Ordinances of the City of Clifton, New Jersey, 1960)]
The following definitions shall apply in the interpretation and enforcement of this article:
GARBAGE
Includes putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
RUBBISH
Includes nonputrescible solid wastes (excluding ashes), consisting of both combustible and noncombustible wastes, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials.
Owners or operators of garden apartment developments shall provide means whereby all garbage and rubbish in garden apartment developments shall be stored, collected and disposed of by use of the disposal systems known as the "Dempster Dumpmaster Disposal System" or the "Dempster Dumpster Disposal System" or similar equivalent system or as is set forth in § 261-6 of this article. In the event that the Dempster Dumpmaster, Dempster Dumpster or similar equivalent disposal methods are used, 0.15 cubic yard of container area shall be provided for each apartment in the garden apartment development.[1]

Owners or operators of garden apartment developments may provide the following alternative means of storing, collecting and disposing of garbage and rubbish in garden apartment developments:
A. 
A twenty-gallon garbage and rubbish container shall be provided for each apartment in the garden apartment development, which container shall be used exclusively by the person or persons living in the apartment for which said container was provided.
B. 
Said containers shall be placed outdoors, below the level of the ground, in metal liners or sleeves with step-on metal lids attached thereto, which metal liners or sleeves shall be inserted into the ground for the sole purpose of having garbage and rubbish containers placed therein.
C. 
Said metal liners or sleeves shall have an opening in the bottom thereof for drainage.
D. 
Each metal liner or sleeve shall be inserted into the ground at a distance of no more than 100 feet from the entrance to the apartment for which the garbage and rubbish container to be placed in said metal liner or sleeve was provided.
E. 
Garbage and rubbish placed in said containers shall be collected daily and shall be disposed of daily at some place other than on the premises of the garden apartment development.

Any owner of a garden apartment development who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $500. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
