The State Uniform Construction Code Enforcing Agency, also known as the "Paterson Construction Code Enforcing Agency," as heretofore established, is hereby continued. The agency shall be a subdivision in the Community Improvements Division of the Department of Community Development.
A. 
The enforcing agency shall consist of a Construction Official, building subcode official, plumbing subcode official, electrical subcode official, fire protection subcode official and other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.[1]

B. 
Each official position created in this section shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-119 et seq. and N.J.A.C. 5:23.

The public shall have the right to do business with the enforcing agency at one office location which, except for emergencies, unforeseen or unavoidable circumstances, shall be located at 111 Broadway, Paterson, New Jersey.

A. 
A fee for a construction permit shall be the sum of the subcode fees listed in §§ 183-5 through 183-7 in addition to a $20 safe disposal fee for debris, which shall be paid before the permit is issued.
B. 
Before a construction permit shall be issued, the applicant shall file with the Construction Official a certification from the Tax Collector that all municipal taxes and/or assessments have been paid and are current with respect to the property for which the application for a construction permit is made.
C. 
The applicant shall file documentation with the Construction Official verifying that all debris has been disposed of at a licensed facility prior to the issuance of a certificate of occupancy.

The building subcode fee shall be:
A. 
For new construction: $0.034 per cubic foot of building or structure volume, provided that the minimum fee shall be $50.
B. 
For renovation, alterations and repairs, estimated cost of the work: $1,000 to $50,000: $30 per $1,000; $50,001 to $100,000: $23 per $1,000; and exceeding $100,000: $19 per $1,000, provided that the minimum fee shall be $90.
C. 
For additions: $0.034 per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be $50.
D. 
Plan review fee shall be 20% of the original permit fee.

A newly constructed retaining wall of any size other than Class 3 residential structures shall be based on the cost of construction as follows:

The fee for plan review shall be 20% of the fee charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit.

The fee for a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be computed the same as new construction, namely, $0.03 per cubic foot, provided that the minimum fee shall be $50.

The fees for certificates of occupancy required for compliance with N.J.A.C. 5:23-2.23 shall be as follows:
A. 
The fee for a certificate of occupancy for a new building and continuing certificate of occupancy on an existing building shall be $151 if the building is solely for residential purposes with no more than two residential units.
B. 
The fee for a certificate of occupancy for a new building and continuing certificate of occupancy on an existing building shall be $30 per unit if the building is solely for residential purposes over two units with a minimum fee of $151.
C. 
The fee for a certificate of occupancy for a new building and continuing certificate of occupancy on an existing building shall be $0.03 per square foot with a minimum charge of $151 if the building is solely for commercial purposes.
D. 
The fee for a certificate of occupancy for a change of use shall be $0.03 per square foot or a minimum fee of $151.
E. 
The fee for a temporary certificate of occupancy shall be $35.

A. 
Pursuant to the Uniform Construction Code, Fire Subcode section, a permit shall be obtained from the fire subcode official of the Fire Division of the City of Paterson or his designee for all automatic sprinkler systems, special suppression systems, standpipes and any and all other related fire protection equipment, prior to the installation or use of any such system or equipment.
B. 
The fee for permits shall be based on the following fee schedule for suppression systems and other related fire protection equipment:

A. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act[1] and the regulations, the enforcing agency shall collect, in addition to the fee specified above, a surcharge fee of $0.00334 per cubic foot of volume of new construction and $1.70 per $1,000 for alterations. Said surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarter ending September 30, December 31, March 31 and June 30, and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal year in which the regulations first become effective, said fee shall be collected and remitted for the first and fourth quarters only.

B. 
The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in the fiscal year. In the fiscal year in which the regulations first become effective, said report shall be for the third and fourth quarters only.
A. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the City Council, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.[1]

B. 
The report shall be structured in accordance with such guidelines as shall be issued from time to time by the Commissioner of the Department of Community Affairs so as to accurately portray true enforcing agency expenses in general and for structures of different use groups.
A. 
There is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency.
B. 
The Board shall consist of five members. At least one Board member shall be a registered architect or a licensed professional engineer of building construction experience, and at least one Board member shall be as qualified as a plumbing subcode official and one as qualified as an electrical subcode official. No more than two Board members shall be selected from the same business or profession.
C. 
Each Board member shall have had at least three years' experience in construction, design or supervision as a licensed engineer or registered architect; or, in the alternative, five years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education; or, as a further alternative, 10 years' experience in construction, design, or supervision as a journeyman in the construction trade or as a construction contractor, subcontractor or inspector.
A. 
The Mayor shall appoint the Board members by and with the consent of the Council. For the members first appointed, the Mayor shall designate the appointees' terms so that one shall be appointed for a term of one year, one for a term of two years, one for a term of three years and two for terms of four years. Vacancies shall be filled for the unexpired term.
B. 
The Mayor shall appoint such number of alternates as may be appropriate, by and with the consent of the Council, for terms not to exceed four years or may, in the alternative, appoint alternates on a case-by-case basis.
C. 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
D. 
Members of the Board shall serve without compensation.
