A person shall not ignite or cause or permit
to be ignited, allow or maintain an open fire. Except as hereinafter
provided, the following types of open fires are exempt from the prohibition
of this section, provided such fires are conducted in accordance with
the conditions specified by the Township and are not injurious to
human health, safety or welfare, animal life, or property, or unreasonably
interfere with the comfortable enjoyment of life or property, or violate
any other section of this chapter:
A.
For the control of crop disease when the county agricultural
agent declares that this is the only means available, provided the
county agricultural agent has issued a permit for such burning;
B.
For training firemen or for research in fire prevention,
provided the Township has given prior written approval;
C.
For the health, safety and welfare of the community
when such fires are ignited by order of a municipal Fire Department;
D.
For the cooking of food for human consumption in a
contained barbecue;
E.
For ceremonial or recreational purposes if properly
controlled by a responsible person and the fuel used is limited to
dry wood, dry paper or smokeless fuel, provided the Township Fire
Chief or his designee has issued a permit for such activity; or
F.
For warming of workers who work predominantly in the
outdoors if the ambient temperature is lower than 32° F. and the
fuel is limited to dry wood, dry paper or smokeless fuel, provided
that fire is contained within a noncombustible container, provided
the Fire Chief or his designee has issued a permit for such activity.
If the Township Fire Chief determines that climatic and/or other conditions have created a situation of extreme fire hazard, the Fire Chief may issue an order temporarily abating the open fire exceptions contained in § 53-1. Such order shall be published in the official newspaper of the Township, shall be effective immediately upon its publication, and shall be substantially in the following form:

NOTICE OF TOTAL BAN ON OPEN FIRES AND OPEN BURNING

WHEREAS, the Township Fire Chief has determined
that climatic and/or other conditions have created a situation of
an extreme fire hazard within the Township; and
| |
|
WHEREAS, the current conditions are such that
any open fires or open burning is a serious threat to the safety and
welfare of persons and property within the Township;

|
NOW THEREFORE, IT IS HEREBY ORDERED that the open fire exemptions contained in § 53-1 of the Township Code are hereby temporarily abated until further order of the Township Fire Chief.

IT IS FURTHER ORDERED that effective immediately
there is a total ban on all open fires and open burning within the
Township.
