[HISTORY: Adopted by the City Council of the City of New Carrollton 4-16-1976 as Ch. 10, § 10.113, of the 1975 Code. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
LOITER
To idle, stand around, tarry or wander on foot, as well as to park, idle, wander, tarry or play in or on a motor vehicle, unless engaged in a lawful business, education, recreational or religious activity or unless accompanied by a parent or guardian.
A. 
It shall be unlawful for any juvenile under eighteen (18) years of age to loiter in any public place or in any place open to the public within the City of New Carrollton between the hours of 10:00 p.m. and 5:00 a.m., Eastern standard time and daylight saving time, of the following day.
B. 
It shall be unlawful for any parent or legal guardian of a juvenile under eighteen (18) years of age to knowingly permit such juvenile to loiter in any public place or in any place open to the public within the City of New Carrollton between the hours of 10:00 p.m. and 5:00 a.m., Eastern standard time and daylight saving time, of the following day.
C. 
It shall be unlawful for any person, partnership, firm or corporation owning or operating or having charge of any place open to the public within the City of New Carrollton to permit any juvenile under eighteen (18) years of age to loiter in such place or places between the hours of 10:00 p.m. and 5:00 a.m., Eastern standard time and daylight saving time, of the following day.

Violation of any provision of this chapter shall be deemed a municipal infraction and shall be punishable as provided in § 1-21A of this Code.
