All powers of the Borough and the determination of all matters of policy shall be vested in the Borough Council, except as otherwise provided by the Charter, general law or this Code.
On January 1, or during the first seven days of January, in each year, the members of the Council shall assemble at the usual place of meeting of the Borough Council and organize and elect one of the Councilmen as Mayor and one as Deputy Mayor. The Mayor and Deputy Mayor shall be chosen by ballot by majority vote of all members of the Council. If the members shall be unable, within five ballots, to elect a Mayor, then the member who in the last two elections for members of the Council received the greatest number of votes shall be the Mayor. Should such person decline to accept the office, then the person receiving the next highest vote shall be the Mayor, and so on until the office is filled.
A. 
The Mayor shall have such powers and duties as Mayor as are vested in him by the Charter, general law or this Code. The Deputy Mayor shall act in place of the Mayor in the case of his absence or disability. The Mayor shall preside at all meetings of the Council and shall have a voice and vote in its proceedings.
B. 
In the absence of both the Mayor and the Deputy Mayor, the Borough Clerk shall call the Council to order and it shall thereupon elect a Chairman Pro Tempore. Upon the arrival of the Mayor or Deputy Mayor, the Chairman Pro Tempore shall immediately relinquish the Chair upon the conclusion of the business immediately before the Council.
C. 
All bonds, notes, deeds, contracts and written obligations of the Borough shall be executed on its behalf by the Mayor or, in the event of his inability to act, by the Deputy Mayor or such Councilman as the Council shall designate to act as Mayor during his absence or disability.
The legislative functions, powers and duties of a municipal board of health under Title 26 of the Revised Statutes shall be vested in and exercised by the Borough Council, and the power of administrative direction and supervision shall be exercised by the Manager.
